ADVERTISEMENT FOR BIDS FAYETTE COUNTY BOARD OF EDUCATION VALLEY PK-8 FLOOD REPAIRS PROJECT Separate sealed Bids for the following installation work and r furnishing of materials will be received by the Fayette County Board of Education, Fayette County, West Virginia, until 2:00 P.M., L.P.T., on Friday, June 28, 2024, at 111 Fayette Ave, Fayetteville, WV 25840. Immediately following the scheduled closing time for the reception of Bids, all Bids which have been submitted in accordance with all Contract Documents will be publicly opened and read aloud. A mandatory Pre-Bid Conference will be held at the Valley PK-8 School located at 1 Greyhound Lane, Smithers, West Virginia 25186, and will be held at 11:00 A.M., L.P.T., on June 12, 2024. Bidding Documents may be examined at the following locations: New River Engineers, Inc. 501 Eagle Mountain Road Charleston, WV 25311 Contractor’s Association of West Virginia 2114 Kanawha Blvd., East Charleston, WV 25311 Contract Documents may be obtained by contacting New River Engineers, Inc. and requesting a free digital copy. A printed copy of the Contract Documents may also be obtained upon a non-refundable payment of $200.00. Bidders wishing to have plans mailed will be charged an additional $25.00 per contract. All Bidders must have a current and valid West Virginia Contractor’s License per Section 21-11-11 of the West Virginia Code. A copy of the Bidder’s Contractor’s License must be submitted in the first envelope and all subcontractors must supply a current and valid contractor’s license number to the primary Bidder prior to award. A five percent (5%) Bid Bond or certified cashier’s check must accompany all Bids. After Bid opening, a Bidder may not withdraw his Bid for a period of ninety (90) days. The Bid opening procedures shall be a two-envelope system. The system shall consist of two separate and distinct envelopes each with proper identification. The envelopes shall be identified as “Bid Opening Requirements” (first envelope) and the other as “Bid Proposal” (second envelope). The first envelope must be submitted in a sealed envelope containing Bid Bond, Certificate of Compliance, Power of Attorney and all other necessary documents as specified in the Bidder’s Checklist. The second envelope must be a separate sealed envelope containing the Form of Proposal for the contract that is being bid. Both the first envelope and second envelope must have the following information in the lower left hand corner: Name and Address of Bidder, Bid for Contract No. 713-01-23 – Valley PK-8 School Flood Repairs Project, Opening Time 2:00 P.M., L.P.T., on Friday, June 28, 2024. The first envelope will be opened first, and Bid Bond, Power of Attorney and Certificate of Compliance and other required documents as listed on the Bidder’s Checklist will be checked to make sure that all the documents are in order. If the documents are found to be in order, the second envelope containing the Bid will be opened and publicly read aloud. If the documents are not in order, then the second envelope shall be returned to the Bidder unopened. At that time, the Engineer will declare the bidder non-responsive. The work to be bid upon is generally described as follows: Contract No. 713-01-23: Valley PK-8 School – Flood Repairs Project 200 LF of H-Pile Retaining Wall and associated infrastructure, site work, and restoration Prospective Bidders are advised that the contract awarded under this Advertisement for Bids is to be funded in whole or in part by the State of West Virginia, Fayette County Board of Education, and Federal Emergency Management Agency (FEMA). Neither the State of West Virginia or the United States nor any of its departments, agencies, or employees is or will be a party to this Advertisement for Bids or any resulting contract. EQUAL EMPLOYMENT OPPORTUNITY Bidders on this work will be required to comply with all applicable standards, orders or regulations in accordance with Executive Orders 11246 and 11375, which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. DAVIS-BACON ACT Davis-Bacon (Federal) Prevailing Wage Determinations must be used in addition to any State prevailing wage rates. The contractor shall use the higher rate for each job classification (between State wage rates and Davis-Bacon wage rates) for paying labor employed in the construction of this project. COPELAND “ANTI-KICKBACK” ACT Bidders on this work will be required to comply with 18 U.S.C. 874, 40 U.S.C. 3145, and the requirements of 29 C.F.R. Part 3 as may be applicable. CONTRACT WORK HOURS AND SAFETY STANDARDS ACT Bidders on this work will be required to comply with statutory requirements on work hours and safety standards. Under 40 U.S.C. 3702, each contractor must base wages for every mechanic and laborer on a standard 40-hour work week. Work over 40 hours is allowed, so long as the worker is paid at least one and a half times the base pay rate for all hours worked over 40 hours in the work week. Additionally, for construction work, under 40 U.S.C. 3704, work surroundings and conditions for laborers and mechanics must not be unsanitary or unsafe. Relevant definitions are at 40 U.S.C. 3701 and 29 C.F.R. 5.2. CLEAN AIR ACT Contractors are required to comply with all applicable standards, orders or regulations issued pursuant to the Clean Air Act, as amended, 42 U.S.C. 7401 et seq. SUSPENSION AND DEBARMENT Recipient shall not entertain the use of businesses that are listed on the “Excluded Parties List System” at www.epls.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180. BYRD ANTI-LOBBYING AMENDMENT Contractors who apply or bid for an award of $100,000 or more shall file the required certification. Each tier certifies to the tier above that it will not and has not used Federal appropriated funds to pay any person or organization for influencing or attempting to influence an officer or employee of any agency, a member of Congress, officer or employee of Congress, or an employees of a member of Congress in connection with obtaining any Federal contract, grant, or any other award covered by 31 U.S.C. 1352. Each tier shall also disclose any lobbying with non-Federal funds that takes place in connection with obtaining any Federal award. Such disclosures are forwarded from tier to tier up to the recipient. DOMESTIC PREFERENCES FOR PROCUREMENT In the performance of this contract, the Contractor shall TO THE GREATEST EXTENT PRACTICABLE, PROVIDE A PREFERENCE FOR THE PURCHASE, ACQUISITION, OR USE OF GOODS, PRODUCTS, OR MATERIALS PRODUCED IN THE United States. This includes, but is not limited to iron, aluminum, steel, cement, and other manufactured products. For purposes of this clause: Produced in the United States means, for iron and steel products, that all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States. Manufactured products mean items and construction materials composed in whole or in part of non-ferrous metals such as aluminum; plastics and polymer-based products such as polyvinyl chloride pipe; aggregates such as concrete; glass, including optical fiber; and lumber.” PROCUREMENT OF RECOVERED MATERIALS In the performance of this contract, the Contractor shall make maximum use of products containing recovered materials that are EPA-designated items unless the product cannot be acquired competitively within a timeframe providing for compliance with the contract performance schedule, meeting contract performance requirements, or at a reasonable price.
