Scarberry, Terry A. Scarberry, City of Huntington, Discover Bank, Citibank, N.A., Citibank South Dakota N.A., Sprint Communications Company L.P., Unknown Persons/Owners, and Charles Zerkle, Sheriff of Cabell County (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Cabell County, West Virginia, and is known as Civil Action No. 19-C-210, and styled AEP West Virginia Transmission Company, Inc. vs. Kim A. Scarberry, et al.Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks the construction of an electrical transmission line and condemnation and right of entry on behalf of AEP West Virginia Transmission Company, Inc. for property situate in the City of Huntington, Gideon District, Cabell County, West Virginia, known and designated as the SOUTHERLY PART OF LOT NUMBER TWENTY-EIGHT (28) IN BLOCK NUMBER THREE HUNDRED THIRTEEN (313), identified as Tax Map 20, Parcel 162, referenced in Deed Book 1164, at page 89, in the office of the Clerk of the County Commission of Cabell County, West Virginia, also described as BLK 313 LT 28, 2618 8th AVE, and being more particularly described as follows: BEGINNING at a point in the north line of 8th Avenue and on the dividing line between Lots 27 and 28 in Block 313, as shown on said Map, which point is westerly 80.5 feet from the intersection of the north line of 8th Avenue and the west line of 27th Street; thence with dividing line between Lots 27 and 28 as shown on said Map North 12 30 West 143.4 feet to the south line of a public alley; thence with same South 72 30 West 78.85 feet to the dividing line between Lots 28 and 29 IN Block 313 as shown on said Map; thence with the dividing line between said Lots 28 and 29, South 15 38 East 150.7 feet to the north line of 8th Avenue; thence with same easterly 70.4 feet to the point of BEGINNING. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Cabell County Circuit Clerk’s office at 750 Fifth Avenue, Huntington, West Virginia, 25701, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for AEP West Virginia Transmission Company, Inc., Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on July 25, 2019, at 10:00 a.m., in the Circuit Court of Cabell County, West Virginia, located at 750 Fifth Avenue, Huntington, West Virginia, 25701, before the Honorable Christopher D. Chiles. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
