NOTICE OF SALE TO: ELIZABETH KEELEY STEELE JONATHAN FREDERICK STEELE Under authority of a certain Deed of Trust dated September 2, 2022, from Elizabeth Steele and Jonathan Steele to Raymond G. Dodson, Trustee, securing JENMAR PROPERTIES, a West Virginia General Partnership, in the amount of $153,164.09, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 4606, at page 560, default having been made in the payment of the obligation secured by said Deed of Trust, and sale having been requested in writing by the holder of the indebtedness secured, the undersigned, Raymond G. Dodson, Trustee, will offer for sale at the front door of the Kanawha County Courthouse on Virginia Street in Charleston, West Virginia, on July 17, 2024, at 10:00 o’clock, a.m., the certain real estate conveyed in said Deed of Trust, bounded and described as follows: All of those certain parcels of real estate, together with the improvements thereon (commonly known as 1595 Washington Street, East) and the appurtenances thereunto belonging, both situate on the southwesterly side of Washington Street, East, between Maxweel Street and Elizabeth Street, in the City of Charleston, Kanawha County, West Virginia, bounded and described as follows: Parcel I BEGINNING at a point in the southerly line of Washington Street, East, which said point is located No. 57DEGREES 15′ W. 228 feet from the intersection of Washington Street, East, and Elizabeth Street, which point is also located in the front line of Lot No. 28 of Block “D’ of the Ruffner Brothers Addition, to the City of Charleston, as shown upon a map entitled, “Nos. 1595-1597 E. Washington Street, being all of Lot 29, Part of Lots 28 and 30, Block “D”, Ruffner Bros. Addition in the City of Charleston, Kanawha County, W. Va. Property of … surveyed by J. Lewis Hark, Registered Professional Engineer, June 15, 1968″, which map is attached to and made a part of a certain deed from Mike J. Costinteen, and Rose H. Costinteen, his wife, to Beech-Nut, Inc., a Delaware corporation said deed being recorded in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1527, at page 15; thence S. 36DEGREES 47′ W. 95.73 feet to an old pin located in the northern line of a 12-foot alley; thence S. 59DEGREES 16′ E. 32.44 feet to a point in the northerly line of said alley; thence N. 36DEGREES 24′ W. 95.5 feet to a point in the southerly line of Washington Street, East, said point also being in the front line of Lot No. 29; thence N. 57DEGREES 15′ W. 31.7 feet to the place of beginning, and being a part of Lot No. 28 and Lot No. 29 of the Ruffner Brothers Addition to the City of Charleston. Parcel II Beginning at an “X” cut on the curb in the southerly line of Washington Street, East, which line is also the front line of Lot No. 30 of Block “D” of Ruffner Brothers Addition to the said City of Charleston, as shown upon the map thereof, duly of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 1, at page 4; and which stake is 31.60 feet west of the point where the easterly line of said Lot No. 30 of Block “‘D” of Ruffner Brothers Addition intersects the southerly line of Washington Street, East, and which stake marks the northwesterly corner of a lot fronting 31.60 feet on the said Washington Street, East, thence towards Kanawha River and binding on said line, S. 37DEGREES 20′ W. 93.57 feet to a stake in the northerly line of a twelve-foot alley, which stake marks the rear westerly comer of said lot; thence with the northerly line of said alley, and being the rear line of Lots No. 29 and 30 of Block “D” of Ruffner Brothers Addition, N. 59DEGREES 16′ W. a distance of 30.26 feet; thence through said Lot No. 29, N. 36DEGREES 24′ E. 94.50 feet to a point in said southerly line of Washington Street, East, which point is 31.70 feet in a westerly direction from the beginning point; thence with the southerly line of Washington Steet, East, and being the front line of Lots Nos. 29 and 30 of Block D” of Ruffner Brothers Addition, S. 57DEGREES 15’ E, a distance of 31.70 feet to the place of beginning; and being part of Lot No. 29 and Lot No. 30, of Block “D” of Ruffner Brothers Addition, being that same property as shown upon a map entitled “Nos. 1595-1597 E. Lewis Hark, Registered Professional Engineer, June 15, 1968,” which map is attached to and made a part of a certain deed from Alvin Ostrin, single, to Beech-Nut, Inc., a Delaware corporation, of record in said Clerk’s office in Deed Book 1527, page 75. Being the same property conveyed unto KEELEY STEELE and JONATHAN STEELE, her husband, by that certain deed dated October 22, 2020, from Charleston Urban Renewal Authority, of record in the aforesaid Clerk’s Office in Deed Book 3080, at page 416. This conveyance will also be made subject to any and all reservations, exceptions, restrictions, rights of way and easements contained in prior deeds affecting said property of record in said Clerk’s office or visible on the ground. This property will be conveyed by Trustee together with the hereditaments thereof and all building, structures and improvements now or hereafter situate thereon and all fixtures, materials, supplies, equipment, machinery and other property as is now or may hereafter be an accession thereto, be a fixture thereto, or be otherwise treated or deemed as a part of the land described herein, all of which is included in the term “property” as used herein. By way of example and not by way of limitation, such fixtures and accessions shall include heating, cooling and air-conditioning units, plumbing and electrical fixtures and equipment, built-in appliances of every kind, boilers, machinery, motors, wall-to-wall carpeting, storm doors and windows, awnings and all furnishings attached to the property. The above-described real estate will be conveyed by the undersigned Trustee to the purchaser by deed containing a Covenant of Special Warranty and subject to all liens, reservations and exceptions appearing in the record of title, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid deed of trust. Purchaser must pay all transfer taxes, delinquent or current real estate taxes, title search and any costs related to recording of any Deed from the Trustee herein. TERMS OF SALE Any successful bidder shall pay 10% of the sales price as a deposit in Certified Funds or Cash at the time of sale with the balance to be paid within 30 days from date of sale. The above-described real estate will be sold by the undersigned Trustee by auction to the highest bidder subject to the right of the Trustee to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above-described deeds of trust and the owner of any other interest in the properties to be sold shall have the right to bid. CONTINUANCE OR ADJOURNMENT OF SALE The Substitute Trustee reserves the right to continue the sale, or adjourn the sale for a time, or from time to time, and the place of sale, as hereinabove set forth, or any continuance or adjournment thereof.
