NOTICE OF TRUSTEE’S SALE Under authority of that certain Deed of Trust dated January 12, 2018 from Rodney Humphreys and Melinda Humphreys to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book No. 4309, at page 975, and Trust Deed Book No. 4287, at page 17, securing a promissory note in the principal amount of $143,545.40, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on July 12, 2024 at 9:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, all that certain lot, parcel or tract of land, together with the improvements thereon and appurtenances thereunto belonging, situate in Poca District, Kanawha County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a 1/2 inch rebar with yellow cap set in the southerly right of way line of WV Secondary Route 347/8 a Right Fork Grapevine Road, in a line of Herbert W. & Barbara J. Dye 50 acre tract, of record in Deed Book 2094 at page 521; thence with line of Dye S. 17DEGREES 05′ 00″ W., passing a corner of Humphreys on the northerly side of Grapevine Creek at 110′, more or less, and continuing with Heyward C. & Brenda A. Humphreys, 12 acre-second tract, of record in Deed Book 1502 at page 325, a total of 214.07 feet to a 1/2 inch rebar with yellow cap set; thence running two (2) new division lines through the Heyward C. & Brenda A. Humphreys 17.6 acre-first tract of record in Deed Book 1502 at page 325 as follows: N. 70DEGREES 08′ 55″ W., 125.66 feet to a 1/2 inch rebar with yellow cap set beside a fence post; thence N. 20DEGREES 45′ 32″ E., crossing the right hand fork of Grapevine Creek at 120.00 feet more or less to a 1/2 inch rebar with yellow cap set beside a water meter in the southerly right of way line of WV Secondary Route 347/8; thence with said right of way S. 65DEGREES 01′ 39″ E. 111.31 feet to the place of beginning, containing 0.594 acres, or 25,860 square feet, more or less, as more particularly shown upon a plat prepared by Dana K. Clendenin, P.S., License No. 981, entitled “Plat of Survey Showing 0.594 Acre Tract Prepared for Heyward C. & Brenda A. Humphreys To Be Conveyed To Rodney C. Humphreys As Being a Part of The 17.6 Acre First Tract of Record in D.B. 1502 Page 325 Situate on the Right Fork of Grapevine Creek, Poca District, Kanawha County, West Virginia,” dated April 5, 2000, Scale: 1″ = 50′. There is excepted and reserved from this conveyance a twenty (20) foot road right of way generally following the presently traveled gravel road from WV Secondary Route 347/8 to the real estate herein described and through the southwesterly corner of said real estate to the residue of Humphreys 17.6 acre first tract and Humphreys 12 acre second tract as shown on the plat of survey. Together with a 2018 CMH Manufactured Home, Serial Number NO2025524TNABCSL. Being the same property conveyed from Heyward C. Humphreys and Breanda A. Humphreys, his wife, to Rodney C.
