TO: RESPONDENTS, NEW PEOPLES BANK, INC., CITIZENS TELECOMMUNICATIONS COMPANY OF WEST VIRGINIA, CITY OF BLUEFIELD, UNKNOWN PERSONS WNERS, AND TOMMY BAILEY, SHERIFF OF MERCER COUNTY, WEST VIRGINIA Notice is hereby given to New Peoples Bank, Inc., Citizens Telecommunications Company of West Virginia, City of Bluefield, Unknown Persons wners, and Tommy Bailey, Sheriff of Mercer County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation ight of Entry has been filed in the Circuit Court of Mercer County, West Virginia, and is known as Civil Action No. CC-28-2024-C-149, and styled Appalachian Power Company vs. New Peoples Bank, Inc., et al. Said Petition for Condemnation ight of Entry under the West Virginia laws of eminent domain seeks property for the construction of an electric substation, electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company, Inc. situate in the City of Princeton, Princeton District, Mercer County, West Virginia, identified as Tax Map 20, Parcel 0009, and recorded in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 830, at page 293, and being more specifically bounded and described as follows: BEGINNING at a concrete monument located in the southerly right of way line of Stafford Drive (WV Route No. 104) (formerly Lazenby Avenue), said concrete monument being located at the northwesterly corner of a tract or parcel of real estate heretofore conveyed to Stafford Drive, Inc. a corporation, by deed from The Prince Corporation, a corporation, dated April 29, 1986 and recorded in the office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 655, page 64; thence with the southerly right of way line of Stafford Drive, S. 58DEGREES 15 00 W., 201.84 feet to a P.K. nail set in pavement; thence S. 49DEGREES 30 00 E., 2.55 feet to a point; thence S. 56DEGREES 09 00 W. 22.70 feet to a 1-1/2 inch iron pipe; thence S. 49DEGREES 22 00 E., 814.71 feet to a point; thence N. 40DEGREES 38 00 E., 43.74 feet to a point; thence N. 49DEGREES 30 00 W., 627.85 feet to a 1/2 inch iron pin; thence N. 58DEGREES 15 00 E. 126.90 feet to a 1/2 inch iron pin; thence N. 31DEGREES 45 00 W., 168.57 feet to the place of beginning, containing 1.391 acres, more or less. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation ight of Entry may be obtained from the Mercer County Circuit Clerk’s office at 1501 Main Street, Princeton, West Virginia, 24740, for the purposes of appearing and defending. The Petition for Condemnation ight of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation ight of Entry will occur on August 12, 2024, at 10:00 a.m., in the Circuit Court of Mercer County, West Virginia, located at 1501 Main Street, Princeton, West Virginia, 24740, before the Honorable William Sadler. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
