Limited Partnership, The City of Huntington, Unknown Persons wners, and Chuck Zerkle, Sheriff of Cabell County (hereinafter sometimes referred to as “the aforementioned respondents”) that a Petition for Condemnation Right of Entry has been filed in the Circuit Court of Cabell County, West Virginia, and is known as Civil Action No. CC-06-2024-C-187, and styled Appalachian Power Company vs. U S Sprint Communications Company Limited Partnership aka Sprint Communication Company L.P. Limited Partnership, et al. Said Petition for Condemnation ight of Entry under the West Virginia laws of eminent domain seeks the construction of an electrical transmission line and condemnation and right of entry on behalf of Appalachian Power Company for property situate in the City of Huntington, Huntington-Gideon District, Cabell County, West Virginia, identified as Tax Map 21, Parcel 10, referenced in Deed Book 925, at page 308, in the office of the Clerk of the County Commission of Cabell County, West Virginia, and being more particularly described as follows: BLK 314 PT LT 25-26 (2702-04) 8TH AVE PUBLIC UTILITY Situated on the Northeasterly corner of 8th Avenue and 27th Street, City of Huntington, County of Cabell, State of West Virginia, more particularly described as follows: Beginning at an iron pin & cap set in the edge of a concrete sidewalk on the Northeast corner of the intersection of 8th Avenue and 27th Street right-of-way; thence with the said right-of-way of 27th Street N 11-30-00 W, 143.22 ft. to a concrete monument set at the intersection of 27th Street and a 10 ft wide (unnamed alley) right-of-way; thence leaving the right-of-way of the 27th street and with the southerly right-of-way line of said unnamed alley N 78-30-00 E, 69.00 ft. to a concrete monument set a corner to lands of Marie Conard DB 887-P397; thence with the west line of said Marie Conard S 11-30-00 E, 132.45 ft. to an iron pin & cap set in the edge of a concrete sidewalk on the northerly right-of-way line of 8th Avenue.; thence with said right-of-way of 8th Avenue S 69-37-27 W, 69.84 ft. to the point of beginning, containing 9511 Square Ft. or 0.218 Acres. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation ight of Entry may be obtained from the Cabell County Circuit Clerk’s office at 750 Fifth Avenue, Huntington, West Virginia, 25701, for the purposes of appearing and defending. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation ight of Entry will occur on August 7, 2024, at 10:00 a.m., in the Circuit Court of Cabell County, West Virginia, located at 750 Fifth Avenue, Huntington, West Virginia, 25701, before the Honorable Sean K. Hammers. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
