NOTICE OF PUBLIC HEARING ON TOWN OF EAST BANK SEWER RATE ORDINANCE A public hearing will be held on August 13, 2024, at 6:00 p.m. on the following ordinance. Any person interested may appear before the Town Council of the Town of East Bank (the “Town”) at the Town Hall, 201 Walnut Street, East Bank, West Virginia, and present any comment or protest thereto. Following such public hearing, Town Council shall take such action as it shall deem proper. The proposed sewer rate ordinance may be inspected by the public at the Office of the Recorder in the Town Hall, 201 Walnut Street, East Bank, West Virginia during regular office hours. SECTION 1 – TARIFF APPLICABILITY Applicable in entire territory served, based on water meter readings. AVAILABILITY OF SERVICE Available for sanitary sewerage service in the entire territory served. RATES The rates shall be based upon flow meter usage and said rates shall be $22.20 per 1,000 gallons of water used. MINIMUM CHARGE The above schedule is subject to a minimum monthly charge of $44.40 per connection to the sewerage facilities. DELAYED PAYMENT PENALTY The above schedule is net. On all accounts not paid in full within twenty (20) days of the billing date, a ten percent (10%) penalty will be added to the net amount shown unpaid. This delayed payment penalty is not interest and is only to be collected once for each bill where it is appropriate. A bill for service to a customer served hereunder, whenever delinquent, shall be a lien for the amount thereof upon the real property or the customer served, as provided by Chapter 16, Article Thirteen, Section Sixteen of the West Virginia Code of 1931, as amended. SERVICE CONNECTION FEE All customers connecting to the sanitary sewer system shall be charged a $350.00 connection fee. Commercial connection shall be charged $750.00. DISCONNECT f%] RECONNECT If service is discontinued for failure to pay a bill when due, a disconnection charge of $20.00 will be assessed and if service is reinstated, a reconnection charge of $20.00 will be made. CUSTOMER CHECK RETURN CHARGE When any check is received for payment of a customer’s account, which check is later returned unpaid due to there being insufficient funds in the account of the payer to satisfy said amount or for any other reason, the customer will have imposed a $20.00 charge. METER DEPOSIT The Town of East Bank shall charge any party or parties a flat rate of $50.00 as a deposit on any new account. SURFACE OR GROUND WATER SURCHARGE Whenever the utility has discovered that a customer’s roof drain, down spout, storm sewer or similar facilities conducting surface water have been connected to the utility’s sewer system, and such customer has failed to take appropriate action, within thirty (30) days of a demand by the utility in accordance with the Rules of the Public Service Commission, to eliminate such connection, a surcharge will be imposed upon the customer calculated on the basis of the following formula: S = A x R x 0.0006233 x C S = The surcharge in dollars A = The area under roof and r the area of any other water collection surface connected to the sanitary sewer, in square feet R = The measured monthly rainfall, in inches/l 0.0006233 = A conversion factor to change inches of rain x square feet of surface to thousands of gallons of water C = The Town’s approved rate per thousand gallons of metered water usage The utility shall not impose the surcharge unless and until the customer has been notified by certified mail, return receipt requested, or by hand delivery, that is has been established by smoke testing, dye testing or on-site inspection that rain or surface water is being introduced into the sanitary sewer system at the customer’s location, and that the customer has not acted within thirty (30) days from receipt of such notice to divert the water from the sanitary sewer system. Said surcharge shall be calculated and imposed for each month that said condition continues to exist. Failure to pay the surcharge and r correct the situation shall give rise to the possible termination of water in accordance with the Rules of the Public Service Commission of West Virginia.
