NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustee, Eric M. Johnson, by that certain Deed of Trust made by Jeffrey A. Ray and Sandi L. Ray, dated August 15, 2018, and recorded August 16, 2018, in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 4321, at page 18, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated March 28, 2024, and recorded April 10, 2024, in the aforesaid Clerk’s office in Trust Deed Book 4687, at page 88, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on August 29, 2024, at 10:45 a.m. all that certain lot, piece or parcel of real property, together with improvements thereon, situate in Charleston, Charleston South Annex District, Kanawha County, West Virginia, being more particularly bounded and described as follows: All those certain lots or parcels of land, together with the improvements thereon, and appurtenances thereunto, belonging Section Two of the James Earl Ingram Subdivision on Sugar Camp Branch of Davis Creek, Loudon District, situate in Charleston South Annex District, Kanawha County, West Virginia, being Lot Number Thirteen-A (13-A) as shown on a map thereof by N.L. Rose, Registered Professional Engineer, of Nitro, West Virginia, dated January 25, 1971, showing a division of Lot Number Thirteen (13), Section Two, a copy of which map is recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia; and which said lot is more particularly bounded and described as follows: BEGINNING at an iron pin on the easterly line of Paula Road corner of original Lot No. 13 and Lot No. 14 of said section Two; thence S 89 58′ E 141.19 feet to an iron pin; thence S 03 07′ E a distance of 60.11 feet to an iron pin; thence crossing through the interior of the original Lot No. 13, N 89 58′ W. 144.7 feet to an iron pin in the line of Paula Road; thence with the same N 0 02′ E a distance of 60 feet to the beginning. And being the same property conveyed to Jeffery A. Ray and Sandi L. Ray, by David A. Walker, by Deed dated July 1, 1999, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2474 at page 636. At the time of execution of the deed of trust, the grantor represented that the address of the property was 1230 Paula Rd., Charleston, WV 25314. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold for cash in hand on the date of sale to the highest bidder. In addition to the payment of the bid, the purchaser of the property at the sale shall be responsible for paying a 10% buyer’s premium to Joe R. Pyle Complete Auction & Realty LLC immediately at the conclusion of the auction. This buyer’s premium is in addition to the winning bid amount. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and WesBanco Bank, Inc., shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
