Marcum, Deborah Sue Marcum Bradley aka Debra Sue Sanders, Glenna Fay Marcum Baldwin aka Glenna Fay McWain, Wanda Lou Harless Heirs, Wendy Nicole Harless c/o Donna Rae Shelton, Sara L. Marcum aka Sara Castle, Roger D. Marcum, Katherine J. Marcum Deck aka Katherine J. Aldridge, Lorraine Marcum, Unknown Persons/Owner, and Randall White, Sheriff of Boone County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that, pursuant to W. Va. Code 54-1-1, et seq., and 54-2-1, et seq., and all applicable West Virginia Statutes, a just compensation hearing previously scheduled for December 19, 2019, has been rescheduled and will be held on February 20, 2020, at 1:30 p.m., in this action in the Circuit Court of Boone County, West Virginia, before Judge William S. Thompson to determine just compensation in relation to a Petition for Condemnation/Right of Entry, which was filed and granted in the Circuit Court of Boone County, West Virginia, and is known as Civil Action No. 19-C-23, and styled Appalachian Power Company v. Jerry L. Marcum, et al. An Order granting Right of Entry was entered on July 11, 2019, in the records of the Circuit Clerk of Boone County, West Virginia. Said just compensation hearing will address real property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate on the waters of the Spruce Fork of Little Coal River in Washington District, Boone County, West Virginia, identified as Tax Map 26, Parcel 77, and recorded in the office of the Clerk of the County Commission of Boone County, West Virginia, in Deed Book 32, at page 426, and in Will Book M, at page 723, and being more particularly described as follows: Lot number fifty (50) of East Ramage, as the same is laid off into lots, streets and alleys on a map thereof made by S.E. Bradley. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry and Order granting Right of Entry may be obtained from the Boone County Circuit Clerk’s office at Boone County Courthouse, 200 State Street, Madison, West Virginia, 25130, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry and Order granting Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that, at the said hearing to determine just compensation on February 20, 2020, at 1:30 p.m., in the Circuit Court of Boone County, West Virginia, located at Boone County Courthouse, 200 State Street, Madison, West Virginia, 25130, before the Honorable William S. Thompson, you may appear for hearing and presentation of evidence, and are notified that any failure to appear and/or present evidence may result in the waiver of any and all defenses or claims, if any, you may have regarding just compensation or otherwise in this action.
