TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 26, 2021, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed of Trust Book 2864, at Page 134, William D. Toney, Jr. did convey unto Larry F. Mazza and Richard A. Pill, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Cabell County Courthouse, in Huntington, West Virginia, on August 21, 2024, at 12:51 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Guyandotte District, Cabell County, West Virginia, and more particularly described as follows: All those certain lots, pieces or parcels of ground situate in Guyandotte District, Cabell County, West Virginia, known and designated on the map of Campbell Park Subdivision Plat No. 2, a copy of which map is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Map Book No. 2, at page 274, as Lots Numbers Fifty-Six (56), Fifty-Seven (57), Fifty-Eight (58), and Lot “B”, TOGETHER WITH all right, title and interest in and to that part of an alley as shown on said Plat No. 2 as lying between Lots 57 and 58 and between said Lots 57 and said Lot “B”, including but not limited to that certain property described in a deed from Realty Factors of West Virginia, Inc., to Owen Clinic, Inc., dated the 18th day of march, 1946, recorded in the aforesaid Clerk’s Office in Deed Book 361, at Page 338. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1598 Campbell Drive, Huntington, WV 25705. AND BEING the same real estate which was conveyed to William D. Toney, Jr., by Deed dated March 11, 2021, from First Priority Federal Credit Union, A Corporation, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 1212, at Page 738. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
