ORDER OF PUBLICATION REGARDING PETITION FOR EMINENT DOMAIN TO: THE ESTATE OF CYNTHIA JEAN SMALLRIDGE-ROBINSON, TIMOTHY M. ROBINSON, JAMES SMALLRIDGE, and THE UNKNOWN HEIRS AT LAW OF CYNTHIA JEAN SMALLRIDGE- ROBINSON, Respondents. You are hereby notified that on the 24th day of July, 2024, the Petitioner, the Huntington Sanitary Board filed with the Circuit Clerk of Cabell County, West Virginia, an Application of the Huntington Sanitary Board, a West Virginia Sanitary District to Condemn Land for Public Use, seeking to obtain and acquire a 813 square foot permanent sewer line utility easement and a 813 square foot temporary construction easement for the construction of a sewer line as well as all necessary rights-of-way for ingress and egres under and across the following described real estate: An easement across part of the property conveyed unto Richard M. Baumgardner, Patricia Ann Baumgardner and Cynthia Jean Smallridge, all as joint tenants with rights of survivorship, by that certain Deed of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 1072, at Page 610. Patricia Ann Baumgardner died June 13, 2007. Richard M. Baumgarder died November 27, 2022. Cynthia Jean Smallridge (Robinson) died March 14, 2024 and her Obituary left as her sole heirs-at-law, Timothy M. Robinson and James Smallridge. There have been no Probate filings to confirm the heirs-at-law of Cynthia Jean Smallridge-Robinson and as such the purpose of this Publication is to provide notice to any other parties having an interest in the estate of Cynthia Jean Smallridge-Robinson. Further, said easement is shown and illustrated on that certain plat attached to the Petition heretofore filed with the Office of the Circuit Clerk of Cabell County, West Virginia and being an easement across property identified as Guyandotte District, Tax Map 7, Parcel 36. Further, the Huntington Sanitary Board has heretofore deposited with the Circuit Clerk of the Cabell County its estimate as to the fair market value of the interest sought to be condemned including damages, if any, to the residue, pursuant to West Virginia Code 54-2-14a, and has obtained from the Court an Order granting Plaintiff a Right of Immediate Entry. A copy of the Petition filed by the Petitioner may be obtained from the Circuit Clerk of Cabell County. You are further notified that a response to the Petition must be filed within thirty (30) days from the date of the second publication herein or default judgment may be rendered against you granting the City the rights and interests sought in the Petition.
