ADVERTISEMENT FOR BIDS Sealed Bids will be received by the City of St. Albans Municipal Utility Commission at their office at 1499 MacCorkle Ave St. Albans, WV 25177 on September 24, 2024, until 2:00 PM (local time). Immediately following the scheduled closing time for the reception of Bids, all Bids that have been submitted in accordance with the conditions of the Contract Documents will be publicly opened and read aloud. The Total Base Bid for each contract shall include all costs for furnishing labor and materials and performing all work set forth in the Contract Documents. The work to be bid upon is described as follows: Contract No. 1 – City of St. Albans MUC City Park 1.0 MG Water Storage Tank – The work consists of the construction of a 1,000,000-gallon glass fused to steel bolted water storage tank together with all related work as specified and shown on the Drawings. Contract No. 2 – City of St. Albans MUC 12″ Water Transmission Main – The work of this contract consists of the construction of approximately 5,000 L.F. of 12″ PVC waterline, 1,700 L.F. of 8″ PVC waterline, 120 L.F. of 6″ PVC waterline, and 100 L.F. of 2″ PVC waterline; gate valves; fire hydrants; meter reconnections; connections to existing lines together with all related work as specified and shown on the Drawings. Construction time limit for Contract No. 1 is 365 days. Construction time limit for Contract No. 2 is 365 days. Said cost includes one (1) full-size paper copy set and one (1) digital (.pdf) copy set including a Bid Submittal Package. The Bid Submittal Package consists of an unbound copy and checklist of items required to be submitted with the Bid. If Bidding Documents are requested to be mailed by the Engineer, Bidders shall pay an additional $40 for the cost of shipping by UPS Ground or FedEx Ground. Bids from anyone not on the Issuing Office’s Plan Holders List will be rejected and returned unopened. The bid opening procedure shall be a two-envelope system. Each Bid for each contract must be submitted in a separate sealed (inner) envelope labeled “Bid Proposal” containing the executed Bid Form and included in a larger sealed (outer) envelope labeled “Bid Opening Requirements” containing those items listed on the Bid Opening Guidelines. Both sealed envelopes must be labeled as stated above and have the following information for the respective contract on which the Bid is made: “Name and Address of Bidder” City of St. Albans MUC Bid on Contract No.__, “Contract Name”. In the event all the required items are not contained in the first envelope, the second envelope shall not be opened, and the Bid shall be declared non-responsive. The lowest responsive Bidder shall be the Bidder who has completed all the requirements for the first envelope to be opened and has the lowest Base Bid on the Bid Form. A pre-bid conference will be held at 2:00 PM (local time) on September 12, 2024, at the City of St. Albans Municipal Utility Commission office located at 1499 MacCorkle Ave St. Albans, WV 25177. Attendance at the pre-bid conference is highly encouraged but is not mandatory. Prospective Bidders are advised that the contracts awarded under this Advertisement for Bids are to be funded by a variety of federal, state, and local funds. Neither the United States, nor the State of West Virginia, nor any of their departments, agencies, or employees is, or will be, a party to this Advertisement for Bids or any resulting contract. Prospective Bidders are hereby advised that it is their responsibility to adhere to all applicable Federal, State, and Local requirements and regulations including but not limited to, Equal Employment Opportunity, Non-Segregated Facilities, Discrimination in Employment, Affirmative Action and Minority Business Participation, the Civil Rights Act of 1964, and the Anti-Kickback Act. Bidders will be required to certify that they do not, and will not, maintain or provide for their employees any facilities that are segregated on the basis of race, color, creed, or national origin. DRUG-FREE WORKPLACE Bidders on this Work are required to comply with the Drug Free Workplace provisions of Code of West Virginia. West Virginia Code 21 1D 5 provides that any solicitation for a public improvement construction contract requires each Bidder to submit at the same time an affidavit of compliance. The enclosed Drug-Free Workplace Affidavit must be signed and submitted in the first envelope as evidence of the Bidder’s compliance with the provisions of Article 1D, Chapter 21 of West Virginia Code. Failure to submit said affidavit in the first envelope shall result in disqualification of such bid. FEDERAL AND STATE WAGE RATES Bidders must comply with Title VI of the Civil Rights Act of 1964, the provisions of the Davis Bacon Act and the Contract Work Hours and Safety Standards Act, the Copeland Anit-Kickback Act, and the WV Division of labor Wage Rates. SUSPENSION AND DEBARMENT Recipient shall not entertain the use of businesses that are listed on the “System for Award Management (SAM)” at www.sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180. DISADVANTAGED BUSINESS ENTERPRISES Each Bidder must fully comply with the Disadvantaged Business Enterprises and Affirmative Action requirements as identified in the Contract Documents. The Bidder agrees to make “good faith efforts” to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of Bids. For the program, the term “subcontract” includes all construction, modification, and service work contracted for by the Bidder in the execution of the work under this contract. WEST VIRGINIA CONTRACTOR’S LICENSE In accordance with WV State Code 30-42-12, all prospective Bidders shall include that person’s WV State Contractor’s License number in the Bid submission. Additionally, all subcontractors shall provide that person’s WV State Contractor’s License number to the Contractor prior to contract award. Any Contractor submitting a Bid on this project hereby certifies, indicates, and acknowledges that he has valid and current West Virginia Contractor’s license on the date of the bid and meets all the qualifications required by the statutes of the State and subdivision in which the work is to be performed. All questions must be submitted in writing by 4:00 PM, on September 17, 2024, to allow for addenda, if needed. No questions after such date will be answered. Email all questions to Robert G. Bids shall be accompanied by a bid bond or a certified check in an amount equal to five percent (5%) of the bid to insure the execution of the contract for which the bid is made. In case the bid is not accepted, the check or bid bond will be returned to the bidder, but if the bid is accepted and the bidder shall refuse or neglect to enter into a contract with the St. Albans Municipal Utility Commission within ten (10) days after the time he has been notified of the acceptance of his bid, the said check or bid bond shall be forfeited to the St. Albans Municipal Utility Commission for the failure to do so. No bidder may withdraw his bid for a period of sixty (60) days after closing time scheduled for the receipt of bids.
