NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated March 13, 2002, executed by Borrower(s), David Alderman and Ottie Alderman, to James B. Crawford, III, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 2817, at Page 352. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 3045 Fields Creek Rd, Winifrede, WV 25214. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 1, 2023, of record in the Clerk’s Office in Book 4672, Page 73. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Less and except the portion of land which was conveyed by deed dated April 8, 2016, from David Alderman to Tiwan Bailey and Destiney Childress, and recorded on April 8, 2016, in Deed Book 2935, Page 673 and described as follows: The surface only of a tract of land in Cabin Creek District of Kanawha County, West Virginia, lying on the waters of Fields Creek, and being part of designated Lot No. 19 of Wrightsville Subdivision, Winifrede, West Virginia, on West Virginia Secondary Route No. 77, more particularly bounded and described as follows: Beginning at a 2` iron pipe set in the southern right-of-way line of West Virginia Secondary Route No. 77 Thence; S. 43-53` E. running a new division line through the Ottie & David Alderman Lot No. 19 of Wrightsville Subdivision recorded in the Office of the Clerk of the County Court of Kanawha County in Deed Book 1827 at Page 380, Thence 99.05 feet to a 12″ sycamore on the north bank of Fields Creek. (Northern right-of-way line of the Winifrede Railroad) Thence S. 57-00` W. with northern bank Fields Creek 148.85 feet to a 9″ sycamore a common corner Winifrede Coal Company 5.896 acres Thence No. 34-34` W. with the line of said to Winifrede Coal Company 44.24 feet to a 2″ iron pipe set in the southern line of West Virginia Secondary Route No. 77 Thence N. 35-00` E. with the southern line of West Virginia Secondary Route No. 77, 14.53 feet to the place of beginning containing 0.24 acres, more or less, as surveyed on the 31st day of August, 1979, by D. Keith Clendenin, S.I.T. under the supervision of Jarrel A. Clendenin, L.L.S. No. 259, and as shown on the plat attached to that deed recorded in the aforesaid Clerk`s Office in Deed Book 1920, at Page 44. Being the same property conveyed to David Alderman and Ottie Alderman by the Deed dated April 29, 1977 and recorded in Deed Book 1827 at Page 382 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
