TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 9, 2002, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 2866, at Page 727, Guy C Porter, Jr did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by US Bank Trust National Association, Not In Its Individual Capacity But Solely As Owner Trustee For VRMTG Asset Trust to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on October 22, 2024 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 13 – Kan C District, Kanawha County, West Virginia, and more particularly described as follows: All of that certain tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Kanawha City District, Kanawha County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a concrete monument in the south right of way line of the Chesapeake and Ohio Railway Company, which concrete monument is located at the northwesterly corner of a tract of 1.712 acres, more or less, conveyed by Abby H. Porter widow, to Betty Lee West Porter by deed dated December 20, 1962, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1374, at page 389; thence with south right of way line of the Chesapeake and Ohio Railway Company by the following courses and distances: S. 47 53′ E., 46.06 feet, S. 48 56′ E. 101 feet; S. 49 50′ E., 101 feet; S. 50 21′ E., 51 feet; and S. 51 18′ E., 50.23 feet to an iron pin in said line; thence with a portion of the west line of the State Road Commission right of way now known as Roundhill Road, S. 40 57′ W. 82.06 feet to an iron pin in said line; thence leaving said line of Roundhill Road, N. 70 19′ W. 158.70 feet to an iron pin; thence S. 28 40′ W., 177.42 feet to an iron pin; thence N. 69 00′ W., 156.62 feet to a stake which is located S. 69 00′ E., 9.60 feet from an “X” cut on a rock; thence N. 12 37′ W. 71.55 feet to an iron pin; thence N. 26 15′ W. 70 feet to a concrete monument at the southeasterly corner of the Betty Lee West Porter; thence with the line of the Betty Lee West Porter property, N. 46 50′ E., 295 feet to the place of beginning, containing 2.113 acres, said property being shown upon a map entitled, “Map Showing Parcel of Land in the City of Charleston, W.Va. conveyed by Abby Porter to Guy C. Porter, Jr. and Betty Lee West Porter”, dated August 4, 1973, made by Field Engineering Co., which map is recorded in the aforesaid Clerk’s Office in Deed Book 1703, at page 263. And being the same property conveyed unto Guy C. Porter, Jr. and Betty Lee West Porter, his wife, by Abby H. Porter by deed dated August 8, 1973, and of record in Deed Book 1703, at page 260, to which deed reference is hereby made for a more particular description of the property herein conveyed. The said Betty Lee West Porter died October 31, 2001 and by the Last Will and Testament of record in Will Book 692, at page 248 she devised her interest in said property to Guy C. Porter, Jr. This conveyance is made subject to the such rights of way, easements, reservations, restrictions, covenants and conditions as the same may be contained in prior deeds of record in the chain of title. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1500 Callie Rd, Charleston, WV 25314. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and r certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
