NOTICE OF SUBSTITUTE SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Substitute Successor Trustees, Eric M. Johnson and L. Elizabeth King, by that certain Deed of Trust made by Lawrence A. Workman, dated February 6, 2007 and recorded February 27, 2007 in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 3441 at page 396, the said Substitute Successor Trustees acting by virtue of that certain Appointment of Substitute Successor Trustee dated August 22, 2024 and recorded September 19, 2024 in the aforesaid Clerk’s office in Trust Deed Book 4712, at page 134, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on Thursday, October 31, 2024, at 10:00 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate in Dry Branch, Cabin Creek District, Kanawha County, West Virginia, being more particularly bounded and described as follows: All that certain lot or parcels of land situate, lying and being on the waters of Dry Branch, a tributary of Cabin Creek, in Cabin Creek District, Kanawha County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a stone pillar at the corner of Lot No. 1 and a ten foot Right of Way; thence N 13 32 W 302 feet to a stone at the corner of Lot No. 1 and said Right of Way, thence, with said Right of Way to the Curry family Cemetery; thence south 30 feet with the line of said cemetery to a stone at the West Corner of Lot no. 1 and the said cemetery to a stone at the West Corner of Lot No. 1 and the said Cemetery; thence, with the said Cemetery 49.43 feet to a stone pillar at the corner of Lots Nos. 2 and 3; thence, with the lines separating Lot Nos. 2 and 3 307.14 feet to a stone pillar in the edge of Dry Branch road; thence, with said road 77.70 feet to the place of beginning, and being Lot Nos. 1 and 2 of the Curry Addition as laid out on Map of same, made by Mortimer McChesney, C.E. and of record in the Clerk’s office of the County Commission of Kanawha County, West Virginia and being the same property that was conveyed unto the parties of the first part herein by deed dated October 20, 1981, from Alva J. Clark and Virginia Clark, his wife, and recorded in the Office of the Clerk, as aforesaid, in Deed Book 1993, at page 295, reference to said deed is hereby made for a more definite and particular description of the property hereby conveyed. At the time of execution of the deed of trust, the grantor represented that the address of the property was Rt. 79 Box 83, Dry Branch, WV 25061. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Substitute Successor Trustees and City National Bank of West Virginia shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Substitute Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
