Pauley Adkins Unknown Heirs, Parker Wilmer Adkins Unknown Heirs, Eual Sidney Adkins Unknown Heirs, Carol Jean Adkins Manley Unknown Heirs, Lenzie Jane Pauley Unknown Heirs, Sara Jane Pauley Unknown Heirs, Kathryn Terry, Bobbie Dene Caldwell, David Allen Johnson, Ramona Casto, Tracy Smith, Richard Cline Johnson Unknown Heirs, Charles “Chuck” Smith Unknown Heirs, Unknown Persons/Owners, and Gary Linville, Sheriff of Lincoln County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Lincoln County, West Virginia, and is known as Civil Action No. CC-22-2024-C-68, and styled Appalachian Power Company v. Hester J. Pauley Adkins Unknown Heirs, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate on the waters of Bowman Fork, a tributary of Fuquays Creek, Washington District, Lincoln County, West Virginia, identified as Tax Map 19, Parcel 28.2, and recorded in the office of the Clerk of the County Commission of Lincoln County, West Virginia, in Deed Book 422, at page 18, and being more specifically bounded and described as follows: FUQUAYS CREEK 48.50 AC ASSD SUR All those certain tracts and parcels of real estate containing 40 acres, and 8-1/4 acres, respectively, conveyed unto Freda P. Pauley, by deed from R.F. Pauley, et ux., dated March 23, 1946, of record in the Office of the Clerk of the County Commission of Lincoln County, West Virginia, in Deed Book 128, page 10. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Lincoln County Circuit Clerk’s office at 8000 Court Avenue, Hamlin, West Virginia, 25523, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on November 15, 2024, at 11:00 a.m., in the Circuit Court of Lincoln County, West Virginia, located at 8000 Court Avenue, Hamlin, West Virginia, 25523, before the Honorable Jay M. Hoke. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
