TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 19, 2000, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 2659, at Page 650, Randall Lee Harless and Angie Lee Harless did convey unto Otis L. O’Connor, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on November 19, 2024, at 5:56 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Marmet Louden District, Kanawha County, West Virginia, and more particularly described as follows: All of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the Town of Marmet, Louden District, Kanawha County, West Virginia, and being part of Lot 4 of Campbell and Reed Addition to the said Town of Marmet as shown upon a map thereof made by Romine S. Snyder, C.E., which map is of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 126, at page 495, said property hereby conveyed being more particularly bounded and described as follows: Beginning at an iron pin in the westerly line of Florida Avenue at the front common corner between Lots 2 and 4 of said Campbell and Reed Addition to the Town of Marmet as shown upon the map aforesaid; thence with said westerly line of Florida Avenue, S. 27 40′ E. 45 feet to an iron pin in said line at the common corner between Lots 4 and 6; thence leaving said line of Florida Avenue and running with a portion of the common division line between Lots 4 and 6, S. 62 20′ W. 84 feet to an iron pin; thence running across Lot 4, N. 25 02′ W. 45 feet to an iron pin in the common division line between Lots 2 and 4; thence with a portion of said common division line between Lots 2 and 4, N. 62 20′ E. 82 feet to the place of beginning, together with the benefits but subject to the burdens of that certain agreement for the use of joint steps between Charles S. Creasy and Mary F. Creasy, his wife, and Frances J. Fraley dated July 15, 1974, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1736, at page 158, the said property hereby conveyed being further shown upon a plat of survey dated June 24, 1974, made by G.G. McClung, L. Land Surveyor, a copy of said plat being attached to that certain deed of record in aforesaid Clerk’s Office in Deed Book 1736, at Page 162. And being the same property conveyed unto Howard A. Justice and Constance Sue Justice, his wife, by Charles S. Creasy and Mary F. Creasy, his wife, by deed dated July 15, 1974, of record in the aforesaid Clerk’s Office in Deed Book 1736, at page 162; and being also the same property conveyed unto Randall L. Harless by Howard A. Justice and Constance S. Justice, his wife, by deed dated October 19, 2000, which said deed is being recorded simultaneously herewith in the aforesaid Clerk’s Office. This conveyance is made subject to any and all covenants, restrictions, and easements as the same may appear in instruments of record in the aforesaid Clerk’s Office. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 9003 Florida Avenue, Marmet, WV 25315. AND BEING the same real estate which was conveyed to Randall Lee Harless and Angie Lee Harless, by Deed dated October 19, 2000, from Howard A. Justice and Constance S. Justice, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2512, at Page 386 The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
