TO: RESPONDENTS, HAROLD HUGHES, HEATHER HUGHES, FRONTIER WEST VIRGINIA INC., UNKNOWN PERSONS/OWNERS, AND GARY LINVILLE, SHERIFF OF LINCOLN COUNTY, WEST VIRGINIA Notice is hereby given to Harold Hughes, Heather Hughes, Frontier West Virginia Inc., Unknown Persons/Owners, and Gary Linville, Sheriff of Lincoln County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Lincoln County, West Virginia, and is known as Civil Action No. CC-22-2024-C-75, and styled Appalachian Power Company v. Harold Hughes, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate in Washington District, Lincoln County, West Virginia, identified as Tax Map 7, Parcel 70.4, and recorded in the office of the Clerk of the County Commission of Lincoln County, West Virginia, in Deed Book 318, at page 607, and being more specifically bounded and described as follows: SUR 0.85 AC BY SURVEY Situate on the divide ridge between Fuquay Creek of Coal River and Ezekiel Branch of Little Coal River approximately 3/4 mile southeasterly along Lincoln County Route 119/6, also known as Starlight Drive, from its intersection with US Route 119, also known as Corridor G, in Washington District, Lincoln County, West Virginia, and more particularly described as follows: BEGINNING on a large marked white oak found on said divide ridge at the common corner between the W. Bruce Roberts 90 acre tract (Deed Book 160, page 379), the Mary Wilma Leibert 48 acre tract (Deed Book 169, page 52), and the property formerly owned by Cline, Myrtle, Guy and Lula Priestley (Deed Book 198, pages 451 and 454); thence with the common boundary line between said Roberts tract and said Leibert tract S. 82 40′ W. 429.00 feet to a 1 1/2 inch iron pipe found on said divide ridge and on the southerly side of Starlight Drive; thence with a new course through a part of said Roberts tract and crossing, then re-crossing, Starlight Drive N. 55 35′ E. 526.04 feet to a 1 1/2 inch iron pipe found on said divide ridge and on the southeasterly side of Starlight Drive at a common corner with said Priestley property; thence with the common boundary line between said Roberts tract and said Priestley property S. 02 00′ W. 242.71 feet to the beginning, containing 0.85 acres, more or less. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Lincoln County Circuit Clerk’s office at 8000 Court Avenue, Hamlin, West Virginia, 25523, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on January 17, 2025, at 10:45 a.m., in the Circuit Court of Lincoln County, West Virginia, located at 8000 Court Avenue, Hamlin, West Virginia, 25523, before the Honorable Jay M. Hoke. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
