Notice Of Public Hearing To Consider West Virginia Requested Approval of UIC Class VI Injection Well Primacy The U.S. Environmental Protection Agency (EPA or the Agency) will hold a public hearing on Monday, December 30, 2024 at the Charleston Marriott Town Center, 200 Lee Street E, Charleston, WV 25301 to ask for public input on the EPA’s intent to approve the State of West Virginia’s request to have primary responsibility (primacy) for enforcing regulation of Class VI wells under the Underground Injection Control (UIC) Program. The public can participate in the public hearing in person or virtually. In addition to the public hearing, EPA requests that written comments be sent on or before December 30, 2024, via the Federal Register for Docket ID No. EPA-HQ-OW-2024-0357. On May 1, 2024, West Virginia submitted to EPA a program revision application to add Class VI injection wells to the State’s Safe Drinking Water Act (SDWA) existing UIC program. Under the SDWA, EPA is required to review applications for primacy of each well class and determine each primacy application is as stringent as the federal regulations and to evaluate the effectiveness of the state’s proposed program. As a result of EPA’s comprehensive review of the state’s application, the Agency is proposing to approve West Virginia’s application because EPA has determined, subject to public comment, that the application meets all applicable requirements for approval. Upon approval, EPA would oversee West Virginia’s administration of the SDWA Class VI program and will continue to oversee West Virginia’s administration of the programs for SDWA Class I through V wells. The last day to register to speak at the hearing will be Monday, December 23, 2024.
