TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 19, 2015, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Document No. 5862352, in Book No. 2587, at Page 120, Robert J McGee and Susan M McGee did convey unto Patrick W. Bryan, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated January 7, 2020 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Peoples Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Fourth Avenue Entrance of the Cabell County Courthouse in Huntington, West Virginia, on February 18, 2020 at 12:00 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in McComas District, Cabell County, West Virginia, and more particularly described as follows: PARCEL NO. 1 All that certain lot, piece or pan:el of land situate in McComas District Cabell County, West Virginia, on the waters of Tom’s Creek, a tributary of the Guyandotte River, and located on West Virginia State Local Service Route 31. (Barboursville-Salt Rock Road), approximately 0.2 miles northerly of its junction with West Virginia State Local Service Route 30, Tom’s Creek Road, and being more particularly described as follows: BEGINNING at a 3/4 inch rebar (found) in the southerly line of the lands of Loretta and Larry Cooper (DB 1049, pg. 166), said rebar being N. 63 degrees 15 minutes 37 seconds E. 8.05 feet from a point in the creek, said point being a common corner in the easterly line of the lands of Clara and Donald Chapman (DB 1049, pg. 168); thence from said beginning rebar and with the southerly line of said Cooper, N. 63 degrees 15 minutes 37 seconds E. 120.22 feet to a point in a concrete driveway at the call of a rebar (not found) and in the westerly right-of-way line of Barboursville-Salt Rock Road (Local Service Route 31); thence, with said road line S. 43 degrees 49 minutes 15 seconds E. 37.58 feet to a 1 1/2 inch pipe (set); thence leaving the said road right-of-way line and severing the lands of Luther Lewis (DB. 612, pg. 641) S. 52 degrees 36 minutes W passing at 156.99 feet a 1 1/2 inch pipe (set), in all 160.02 feet to a point in the said easterly line of Chapman; thence with said Chapman line N. 11 degrees 25 minutes 14 seconds W. 67.94 feet to a point in the creek, thence leaving said Chapman line and with the said line of Cooper N. 63 degrees 15 minutes 37 seconds E. 8.05 feet to the place of beginning, and containing as area of 0.165 acre. more or less, as shown on the plat of survey, recorded in Deed Book 1085 at page 400-B. PARCEL NO.2 All that certain lot, piece or parcel of land situate in McComas District, Cabell County, West Virginia, on the waters of Tom’s Creek, a tributary of she Guyandotte River, and located on West Virginia State Local Service Rouge 31, Barboursville-Salt Rock Road, approximately 0.2 miles north of its junction with West Stage Local Service Route 30, Tom’s Creek Road, designated as PARCEL C and being more particularly bounded and described as follows: Beginning at a rebar (set) on the southwest side of Barboursville-Salt Rock Road, the said rebar bears North 57 degrees 34 minutes 34 seconds West, a distance of 10.00 feet from a power pole; thence South 63 degrees 15 minutes 37 seconds, West, a distance of 128.27 feet to a small creek; thence up the said creek North 11 degrees 28 minutes 08 seconds West, a distance of 186.04 feet; thence North 05 degrees 16 minutes 21 seconds, East, a distance of 19.15 feet to the southwest right of way of the said road and being in the said creek; thence along and with the said road right of way South 46 degrees 11 minutes 35 seconds East, a distance of 207.55 feet, to the BEGINNING, containing 0.300 acres, or 13.064.734 square feet of land, more or less. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 2398 McComas Road, Barboursville, WV 25504. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
