NOTICE OF SALE NOTICE OF SALE is hereby given pursuant to and by virtue of the authority vested in Brandon Steele, Special Commissioner, by the Order to Sell Property entered January 28, 2025 in the matter of Patriot Roofing & Framing LLC v. Michael Lovejoy and Morgan Lovejoy, Civil Action No. 03-2020-C-90 by Judge Nowicki-Eldridge, Judge of the Circuit Court of Boone County, West Virginia. The Order to Sell Property instructs the Special Commissioner to sell the following described property to the highest bidder at the front door of the Courthouse of Boone County, in Madison, West Virginia on: February 28, 2025 at 2:00 p.m. TRACT ONE: BEGINNING on a set stone on State right of way No. 79, thence running up said State right of way line a distance of Seventy-four (74) feet to a set stone and a corner to the land of the second party; thence running with the line of the party of the second part a distance of four hundred ten (410) feet to a set stone in the Old County Road; thence running with the old county road a distance of 11 feet to a set stone; thence running a straight line a distance of Three Hundred (300) feet to a set stone, the beginning corner. The said parties of the first part do hereby reserve from this conveyance a path or walkway across this lot which joins with another path across the property of the second party. TRACT TWO: BEGINNING on a set stone on the right of way line of State Route No. 79 and a corner to Fred Sutphin=s lot; thence running with the said Sutphin line a distance of 211 feet more or less, and being in four feet of the Dr. Glover lot; thence running parallel with and four feet from the Dr. Glover lot a distance of 50 feet to a stake; thence running a straight line a distance of 184 feet to a stake in the State Road right of way line; thence running with the said State Road right of way line a distance of 50 feet to the beginning. And being all of the same property as is set forth in Deed Book 298, at Page 99 in the Office of the Clerk of the County Commission of Boone County, West Virginia. TERMS OF SALE: 1. The property will be conveyed in an “AS IS” condition by Quit Claim Deed containing no warranty, express or implied of the condition of the property,, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office affecting the subject property. 2. Patriot Roofing has the right to submit a bid for the property at sale. 3. The Special Commissioner reserves the right to continue the sale of the subject property from time to time by oral or written proclamation, which continuance shall be in the sole discretion of the Special Commissioner. 4. The total purchase price is payable to the Special Commissioner by certified or cashier’s check within fifteen (15) days of the date of sale.
