NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated November 28, 2012, executed by Borrower, Kevin L Lewis Jr, to Bailey Joseph and Slotnick PLLC, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3917, at Page 666. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 811 Vogel Dr, Charleston, WV 25302. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 23, 2024, of record in the Clerk’s Office in Book 4678, Page 818. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 3RD DAY OF MARCH, 2025 AT 11:15 A.M. All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, lying and being in the City of Charleston, Kanawha County, West Virginia, have a frontage of forty (40) feet on the southerly side of Vogel Drive, being shown and laid down as Lot No. 21, on the “Corrected Map Showing Lots Nos. 18, 19, 20, 21, 22 and 23, as Previously Shown on Revised Map Showing Re-subdivision of Lots Nos. 110 to 116, inclusive, of the Glenwood Heights Addition to Charleston, West Virginia, owned by E. M. Vogel” of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Map Book 5, at page 27, and being more particularly bounded and described as follows, to-wit: Beginning at an iron pin on the southerly side of Vogel Drive, which is 220 feet in a westerly direction from the intersection of said Vogel Drive with Park Avenue, and which is also the common front corner of Lots Nos. 20 and 21 of said Re-subdivision; thence with the dividing line between said Lots Nos. 20 and 21, S. 5 31`W. a distance of 102.93 feet to an iron pin at the common rear corner of said Lots Nos. 20 and 21; thence with the rear line of said Lot No. 21, S. 83 48` W., a distance of 55 feet to an iron pin at the common rear corner of Lots Nos. 21 and 22 of said re-subdivision; thence with the dividing line between said Lots Nos. 21 and 22, N. 12 21` E., a distance of 115.98 feet to an iron pin in the southerly side of said Vogel Drive at the common front corner of said Lots Nos. 21 and 22; thence with the southerly side of said Vogel Drive, S. 82 58` E., a distance of 40 feet to the place of beginning. This conveyance is subject to the restrictive covenants and conditions as described and contained in that certain deed made by E. M. Vogel and Amelia Vogel, his wife, to Forrest P. Fisher, dated December 20, 1938, and of record in the aforesaid Clerk`s office in Deed Book 486, at page 419. And being the same property conveyed to Danny Cline and Darlene J. Brown, by Danny Cline, by deed dated January 6, 2010, of record in the aforesaid clerk`s office in Deed Book 2760, at page 205, to which map and deed reference is here made for a more particular description of the property herein conveyed. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
