NOTICE OF TRUSTEE’S SALE Under authority of that certain Deed of Trust dated December 29, 2008, from Nicholas C. Walton to Casie McGee, Trustee, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book No. 3621, at page 781, securing a promissory note in the principal amount of $65,021.52, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Substitute Trustee will offer for sale at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on February 19, 2020 at 9:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, the following described real estate, together with the improvements thereon and the appurtenances thereunto belonging: Situate on the northern side of U.S. Route 21 Sissonville Drive on the Waters of Tupper’s Creek, in the Poca District, Kanawha County, West Virginia, As shown on “Plat of Survey . . . by Timothy L. Keely – WV PS No. 972 . . . dated December 5, 2008”. Beginning at a point on the southern right of way of Geneva Circle at the northeastern corner of an old Cemetery; thence leaving said cemetery and crossing Geneva Circle making a new division line through the aforesaid Hodge tract of land, running up the hill N 1-0-33 E, 81.20′ to a point; thence along the hillside N 62-2-00 E, 275.00′ to a 3/4″ steel rod found on the Boggess line (Deed Book 680, Page 281 – Tax Map 30 Parcel 56); thence down the hill with the Boggess line by a gas line S 64-06-00 E, passing a 1/2″ pipe found at (80′) and continuing (120′) being a total of 200.00′ to a 3/4″ steel rod; thence leaving Boggess, and now running along the hillside with Lot (4), S 46-58-00 W, 104.06′ to a 5/8″ rebar found; thence with Lot (3), S 52-18-00 W, 175.00′ to a point on the northeastern edge of a 40′ right of way; thence leaving Lot 2 (3) and now crossing said right of way S 41-15-07 W, 40.76′ to a 5/8″ rebar found; thence leaving said right of way and now running with Lot (2), S 42-07-00 W, 162.56′ to a 5/8″ rebar found; thence leaving Lot (2), and now running up the hill N 27-12-00 W, 164.38′ to a 1/2″ pipe found at the southeastern corner of the aforesaid Cemetery; thence continuing up the hill with the eastern line of said Cemetery, N 0-27-30 E, 61.44′ to the point of beginning, containing 2.00 Acres, more or less. Together with a right of way and easement, with utility easement over and across that certain 40 foot wide right of way referenced above, for purposes of ingress and egress from West Virginia Route 21 to the above described real estate, said road right of way more particularly shown on that certain plat dated December 5, 2008. Terms of sale: Ten percent nonrefundable cash deposit due at sale. Ninety percent balance of purchase price due within thirty days of date of sale.
