Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Bank of America, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on April 15, 2025 at 10:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 25 – Union District, Kanawha County, West Virginia, and more particularly described as follows: All that certain tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on Rocky Fork of Pocatalico River, in Union District, Kanawha County, West Virginia, and being Part of Lot No. 12, as shown upon a map of Lot No. 12, entitled “Plat of Survey Showing Lot No. 12 of the Proposed Eckenrode Estates…Situate on Rocky Fork of Poca River Union District, Kanawha County, West Virginia”, dated December 7, 1998, made by Timothy L. Kelly, P.S., of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2463, at page 427, the tract or parcel hereby conveyed being more particularly bounded and described as follows: BEGINNING at a 1/2″ rebar located at the point of intersection of the easterly right of way line of Montana Road with the northerly right of way line of Amy Road as shown upon the aforesaid map; thence running with the easterly right of way line of Montana Road, N. 0 38′ 42″ E. 283.25 feet to a point; thence leaving the right of way line of Montana Road S. 42 14′ 31″ E. 293.91 feet to a point in the northerly right of way line of Amy Road; thence running with the northerly right of way line of Amy Road, S. 60 36′ 52″ W. 82.84 feet to a point in said right of way; thence continuing with said right of way line, S. 79 00′ 00″ W. 131.00 feet to the point of beginning, containing 0.69 acre by survey and being Part of Lot No. 12, together with a non-exclusive right of way and easement to be used in common with others having the right to use the same for purposes of ingress, egress and utilities, to and from the public road and the property hereby conveyed, in, on and under the 80-foot right of way as shown upon the subdivision map, and the 40-foot right of way as shown thereon, and the streets in said subdivision. And being the same property conveyed to the Grantors herein by deed dated February 14, 2005, from Francis John Rupersburg and Ida Jean Rupersburg, of record in said Clerk’s office. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 120 Amy Rd, Charleston, WV 25312. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
