TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 1, 1990, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Document No. 110255, in Book No. 1976, at Page 178, Evelyn S Ingram and James R Ingram did convey unto John Neuner, III and Rodney B. Frye, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated January 21, 2020 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on March 3, 2020 at 4:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 12 – CHAS W District, Kanawha County, West Virginia, and more particularly described as follows: All of that certain lot or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Kanawha County, West Virginia and being more particularly described as: PARCEL ONE: All of Lot No. Fourteen A (14A) as set out, laid down and designated upon a map or plat entitled “Map Showing Resubdivision of Lots $14-#15-16-17 & 18 of the Luna Park Addition to Charleston, West Virginia”, which map or plat was prepared by W.G. Crichtron, Engr. Co., bears date of August 2, 1927, and is recorded in the office of the Clerk of the County Court of Kanawha County, West Virginia, in Photostatic Map Book 6, page 15; PARCEL TWO: Beginning at a 1″ iron pin said pin is 519.41 E. 13.92′ from the edge of Lovell Drive and also on the line of Lot 12 and Lot 14A of the Luna Park Addition in the City of Charleston; thence 555.00 E. 55′ with the line between Lot 14A and 12 to a fence post, thence; 535.00 W. 40′ leaving Lot 14A and running with the line between 13 and 12 to a fence post on the corner of Lots 10, 11, 12 and 13 and running through Lot No. 12 to the beginning, and containing in all 1,100 square feet; and being a part of the property conveyed to Raymond D. Miller and Virginia Miller, his wife, by deed dated the 19th day of November, 1973, by James R. Ingram and Evelyn S. Ingram, his wife, and recorded in the office of the Clerk of the County Commission in Deed Book 1422, at page 373. And being the same two parcels of land conveyed to James R. Ingram and Evelyn S. Ingram, his wife, by deed dated the 19th day of November, 1973, by Raymond D. Miller and Virginia Miller, his wife, and recorded in the office of the Clerk of the County Commission in Deed Book 1422, at page 373. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 207 Lovell Drive, Charleston, WV 25302. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
