NOTICE OF TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned, J. Nicholas Barth, Successor Trustee, by that certain Deed of Trust made by Building Appalachia, LLC to Robert H. Skeen, Jr., Trustee, bearing date May 31, 2022, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 4589 at page 709; the said J. Nicholas Barth acting as Successor Trustee by virtue of that certain Appointment of Successor Trustee dated April 17, 2025, of record in the aforesaid Clerk’s Office in Trust Deed Book 4741 at page 719; and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, the undersigned Successor Trustee will offer for sale, at public auction, to the highest bidder at the North Front Door of the Courthouse of Kanawha County, West Virginia, in the City of Charleston, West Virginia, on the 22nd day of May, 2025, at 11:00 o’clock p.m., twelve (12) lots or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Kanawha County, West Virginia, and being more particularly bounded and described as follows: PARCEL ONE: All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of South Charleston, Jefferson District, Kanawha County, West Virginia, and being more particularly bounded and described as follows, to-wit: BEING known and designated as all of LOT NUMBER ONE HUNDRED EIGHTY-FIVE (185) in BLOCK “D”, OF THE GOSHORN ADDITION to Spring Hill, as the same is shown on a Map of said Addition, entitled “Map of the Goshom Addition To Spring Hill, Kanawha County, W. Va,.”, dated February 23, 1918, as prepared by Gardiner S. Plumley, Engr., and of record in the office of the Clerk of the County Court of Kanawha County, West Virginia, in Map Book 2, at page 82; and as further shown on the Revised Map of said Addition, prepared by H. J. Burtnette, Engr., dated December 1, 1940, and of record in said Clerk’s Office in Map Book 12, at page 54; said parcel fronting a distance of forty (40) feet on Meadow Drive in said Addition, and extending back therefrom between parallel lines a distance of one hundred twenty-five (125) feet, all as shown on the forementioned maps; LSOT: Deed Book 1432, Page 639, dated April 12, 1965. PARCEL TWO: All that certain tract or parcel of land, together with the improvements thereon and the appurtenances: thereunto belonging, situate in the City of Dunbar, Kanawha County, West Virginia, and being a part of the lot which originally fronted 123.3 feet on the south side of Coon Avenue and extended back therefrom with the line of Eastern Avenue to the river, as shown on the map entitled “Map of Coon Addition to Dunbar, Union District, Kanawha County, West Virginia. Scale 1″ = 40′, December 22, 1923,” of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, Photostatic Map Book No. 4, at Page 151, the lot or parcel of land hereby conveyed being more particularly bounded and described as follows, to-wit: BEGINNING at an iron pipe located at the southeasterly comer of the intersection of Coon Avenue and First Street (formerly Eastern Avenue): thence with Coon Avenue N. 66 34′ E. 49.3 feet to an iron pipe; thence leaving Coon Avenue and running S. 27 4’E. 113.2 feet to an iron pipe; thence S. 66 40′ W. 92.3 feet to an iron pipe in the easterly line of First Street (formerly Eastern Avenue); thence running with said First Street N. 6 15′ W. 117.6 feet to the place of beginning. PARCEL THREE: All of the following described real estate, together with the improvements thereon and appurtenances thereunto belonging and more particularly described as follows: A certain lot situate in Union District, Kanawha County, West Virginia being Lot No. 70 of the Thurston Addition to Dunbar, as laid out in lots, streets and alleys upon the map of the same by C. A. Casci, Civil Engineer, which map is filed and recorded in the office of the Clerk of the County Commission of Kanawha County, West Virginia. LSOT: Deed Book 1911, Page 519, dated June 29, 1979. Thereafter, Elizabeth A Morris died on November 22, 2010. PARCEL FOUR: All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Dunbar, Kanawha County, West Virginia, and being more particularly bounded and described as follows, to-wit: BEING known and designated as all of LOT NUMBER TWO HUNDRED FORTY-ONE (241), in BLOCK “U”, as shown, set out laid down and designated upon a map or plat of said City of Dunbar, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Photostatic Map Book 1, art page 146; said lot being also shown upon a subsequent map of said City of Dunbar, of record in the aforesaid Clerk’s office in Photostatic Map Book 3, at page 157; said lot fronting forty (40) feet on the southerly line of West Virginia Avenue, and extending back therefrom in a southerly direction between parallel lines a distance of 120 feet to the northerly line of a ten foot alley. LSOT: Deed Book 2125, Page 386, dated June 11, 1986. Thereafter, Elizabeth A. Morris died on November 22, 2010. PARCEL FIVE: All that certain parcel of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Dunbar, Kanawha County, West Virginia, being more particularly bounded and described as follows: All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Dunbar, Kanawha County, West Virginia, and being the easterly one-half (1/2) of Lot No. Ninety-seven (97) in Block N of said City of Dunbar, fronting 26 14 feet on Grosscup Avenue and extending back 120 feet, more or less, to an alley, as the same is shown upon a map of Dunbar, of record in said Clerk’s office in Map Book 2, at page 89. LSOT: Deed Book 2193, Page 481, dated November 25, 1987. Thereafter, Elizabeth A Morris died on November 22, 2010. PARCEL SIX: All that certain lot or parcel of land together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Dunbar, Kanawha County, West Virginia, being all of Lot Three (3) and the easterly 30 feet of Lot Two (2), Block 36, as shown upon that certain map entitled “Revised Map of Dunbar” made by Clark and Krebs, Inc., C. E. dated July 20, 1920, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Map Book 2 at page 89, and being more particularly described as follows: BEGINNING at a stake in the northerly right of way line of Moore Avenue, said stake being the front common comer of Lots 3 and 4; thence with said right of way line of Moore Avenue N. 69 18′ W. 70 feet to an iron pin; thence N. 20 42′ E. 120 feet to a stake in the right of way line of Fletcher Avenue; thence with said right of way line of Fletcher Avenue S. 69 18′ E. 70 feet to a stake; thence S 20 42′ W. 120 feet to the place of beginning; and being the same property as shown upon a map entitled “Part of Lot 2 & All of Lot 3 Block ’36’ Dunbar Revised” dated November 21, 1986, made by Field Surveying, Inc. LSOT: Deed Book 2146, Page 92, dated December 15, 1986. Thereafter, Elizabeth A Morris died on November 22, 2010. PARCEL SEVEN: All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Dunbar, Union District, Kanawha County, West Virginia, fronting Thirty (30) feet on Smith Street and being Lot No. 32, Block “X”, of the City of Dunbar, West Virginia. LSOT: Deed Book 1845, Page 320, dated September 27, 1977. Thereafter, Elizabeth A. Morris died on November 22, 2010 PARCEL EIGHT: All that certain lot or parcel of land together with the improvements thereon and the appurtenances thereunto belonging, fronting 30 feet on the westerly side of 17th Street, known and designated as Lot Number 6, Block 11, and shown upon that certain map entitled “Revised Map of Dunbar” made by Clark and Krebs, Inc., C.E., dated July 20, 1920, filed and recorded in the office of the Clerk of the 1 County Court of Kanawha County, West Virginia. LSOT: Deed Book 2177, Page 447, dated August 25, 1987. Thereafter, Elizabeth A. Morris died on November 22, 2010. PARCEL NINE: All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Dunbar, Kanawha County, West Virginia, and being Lot Number Twenty-Two (22), Block Thirteen (13), as shown upon a map of the City of Dunbar of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 3, at page 157. LSOT: Deed Book 2211, Page 877, dated September 23, 1988. Thereafter, Elizabeth A. Morris died on November 22, 2010. PARCEL TEN: All of those certain lots or parcels of land; together with the improvements thereon and the appurtenance thereunto belonging, situate in the city of St. Albans, Kanawha County, West Virginia, and being all of lots numbers Seven (7) and Eight (8) in Block “F” of the Chandler Addition to St. Albans, as shown upon a map thereof made by M.W. Venable & Son, Engineers, which map is recorded in the office of the Clerk of the County Court, Kanawha County, West Virginia in Map Book 2, at page 154. LSOT: Deed Book 1662, Page 384, dated July 25, 1977. Thereafter, Elizabeth A. Morris died on November 22, 2010. PARCEL 11: All of that certain lot or parcel of land, together with the improvements thereon and appurtenances thereunto belonging situate in the City of Dunbar, Kanawha County, West Virginia, and known and designated as all of Lot 59. Block L to the City of Dunbar as shown upon the map thereof recorded in the Office of the Clerk of the County Court in Kanawha County, West Virginia, in Map Book 3, at page 157. LSOT: Deed Book 1610, Page 282, dated December 26, 1970. Thereafter, Larry W. Morris died on May 30, 2004. PARCEL 12: All those certain lots or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Dunbar, Kanawha County, West Virginia, and being all of Lot Nos. Forty-Eight (48) and Forty-Nine (49) in Block “W”, as shown on a map of the City of Dunbar, which said lots each front 30 feet on Pritchard Street, now 17th Street, and extend back therefrom 160 feet to an alley. There is expressly EXCEPTED and RESERVED from the description of the foregoing lots that certain portion of the same which was acquired by the State Road Commission of West Virginia, in a condemnation proceeding against Louise Dawson, the then owner of said lots. Reference is expressly made to the description of the land taken by the State Road Commission is fully set forth in Deed Book 1455, at page 81. LSOT: Deed Book 2369, Page 602, dated July 26, 1995. Thereafter, Larry W. Morris died on May 30, 2004. The referenced property will be conveyed with covenants of special warranty subject to all further covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground. TERMS OF SALE: Cash in hand at time of sale, subject to all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The above-described property will be conveyed by the undersigned Successor Trustee to the purchaser by deed containing a covenant of Special Warranty and subject to all liens, reservations and exceptions appearing in the record of title, and to the liens of all unpaid taxes, if any, which are entitled to priority over the lien of the Deed of Trust. Purchaser must pay all transfer taxes, delinquent or current real estate taxes, title search and any costs related to recording of any deed from the Successor Trustee. Pursuant to the terms of the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
