NOTICE OF TRUSTEE’S SALE Under the authority of that certain Deed of Trust made on June 25, 2018, from Jody Lee Gooslin, II and Katrina Michelle Burke to Greg K. Smith and Harry K. White, Trustees, of record in the office of the Clerk of the County Commission of Mingo County, West Virginia in Trust Deed Book No. 471, at page 298, securing a promissory note payable to the Bank of Mingo, now known as Guaranty Bank Corp. and default having been made pursuant to the promissory note secured by the aforesaid Deed of Trust and sale requested by the Bank of Mingo, now known as Guaranty Bank Corp, as beneficiary of the aforesaid Deed of Trust, the undersigned Substitute Trustee, appointed by Appointment of Substitute Trustee and recorded in the aforesaid clerks office, will offer for sale at the front door of the Mingo County Courthouse located in Williamson, Mingo County, West Virginia on June 20, 2025 at3:15 ET p.m. subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, all that certain tract, piece or parcel of real property, together with all improvements thereon, and being more particularly bounded and designated as having a street address of 241 Recreation Drive, Williamson, West Virginia 25661 and a full legal description of the property being offered for sale is as follows: Beginning at an iron pipe in the northeast corner of Ten Pin Alley’s 2.29 Acre Parcel and being N 67 47′ 14″ E 117.26 feet from a concrete right-of-way marker which serves as a point in the southern right of way of U.S. Route No. 52 and is about 278 feet north of Buffalo Creek; thence leaving said Ten Pin Alley, N 65 47′ – 30″ E 233.99 feet to a concrete right of way marker on the southside of U.S. Route No. 52; thence, with said right of way, N 88 13′ 31″ E127.26 feet to a concrete right of way marker on the south side of U.S. Route No. 52 and on the line of John Messerian; thence, leaving said right of way and with Messerian, S 01 30′ 01″ E 291.50 feet to an iron pin in center of Buffalo Creek; thence, continuing with Messerian and down the meanders of said creek, S 76 28′ 31″ W 218.85 feet to the southeast corner of Ten Pin Alley, Messerian, and the center of the creek; thence, leaving the creek and Messerian and with Ten Pin Alley, N 29 00′ 54″ W 199.62 feet to an iron pipe in the line of Ten Pin Alley, thence continuing with Ten Pin, N 29 33; 39″ W 78.33 feet to the beginning, and containing 1.94 acres, more or less. Being in all respects the same real estate conveyed unto Jody Gooslin, II and Katrina Michelle Burke, as joint tenants in common, from Rosangela Stepp, widow, by Deed of Conveyance dated June 21, 2018, of record in the Office of the Clerk of the County Commission of Mingo County, West Virginia, in Deed Book 484, at Page 334. The referenced real estate is to be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant, owner or persons occupying the subject property to vacate said property. The sale of the property will be subject to all matters having priority over the deed of trust referred to herein including all assessments and taxes and all prior liens, deeds of trust, judgments. The property being offered for sale and foreclosed upon is the property set forth in the legal description herein together with all improvements thereon. FEDERAL TAX LIEN: in the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may adjourn or postpone the sale by public announcement at the time and place designated or by posting a notice of the same. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale and/or to submit a bid which may be in the form of a credit bid.
