TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated April 16, 2012, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 3869, at Page 610, Charles A. Addison did convey unto R. Vance Golden, III, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on July 2, 2025, at 5:37 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Louden District, Kanawha County, West Virginia, and more particularly described as follows: SITUATE and being at Hernshaw, on the waters of Lens Creek, in Louden District, Kanawha County, West Virginia, and being all of “Tract No 1” set out, laid upon and designated upon a map on plat entitled “Plat Showing Tract 1 and Tract 2, Hudson Heirship Property, Louden Dist. Hernshaw, W.Va.”, which map or plat was prepared by Ralph Atkins, bears date of March 17, 1964, and is made a part hereof, incorporated herein for all pertinent purposes, said “Tract No. 1” herein conveyed being more particularly bounded and described as follows: BEGINNING at a stake located on the northerly right-of-way line of U.S. Route No. 119, which said beginning point is located at the southerly most common corner between Tract No. 1 and Tract no. 2 of the Hudson Heirship Property, as shown upon the aforesaid map or plat; thence leaving the northerly right-of-way line of U.S. Route No. 119 and running with the common division line between Tract No. 1 and Tract No. 2 N. 14 00′ W. a distance of 90.0 feet to a stake located at the toe of the hill; thence continuing with the common division line between Tracts Nos. 1 and 2, N. 22 24′ W. 395.0 feet to a stake; thence leaving the common division line between Tracts Nos. 1 and 2, S. 66 00′ E. 24 feet to a stake on the side of the hill; thence S. 22 24′ E. a distance of 224.0 feet to a stake; thence S. 89 45′ E. a distance of 490.0 feet to a stake located on the northerly right of way line of U.S. Route No. 119; thence running with the northerly right of way line of U.S. Route No. 119, S. 55 15′ W. 257.0 feet to a point on said right of way line; thence continuing on said right of way line S. 64 34′ W. 229.0 feet to the beginning, containing 1.32 acres, more or less; There is reserved those two certain cemeteries, the first known as “The Hawks Cemetery”, a public cemetery and the second a private family cemetery reserved for John W. Hudson and Maude Hudson and their heirs, and the right of way leading thereto. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Charles A. Addison, 2826 Lens Creek Road, Hernshaw, WV 25107. AND BEING the same real estate which was conveyed to Charles A. Addison by Deed dated April 16, 2012, from Anita Yvette Elkins nka Anita Yvette Kirk, Executrix of the Estate of Dorothy Lee Elkins, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2820, at Page 913. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
