TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated July 9, 2012, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 3894, at Page 269, Kevin C. Forsbrey and Michele Guthrie a/k/a Michele Forsbrey did convey unto Todd Taylor and Dan Kennedy, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on July 2, 2025, at 5:41 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Union District, Kanawha County, West Virginia, and more particularly described as follows: All that certain tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on Doc Bailey Road, WV Route 10 (formerly Clay Bank Branch Road), Union District, Kanawha County, West Virginia, about 0.7 miles north of State Route 622, more particularly described as follows: BEGINNING at a 1/2″ rebar, on the east side of Clay Bank Branch I the west line of a 30 foot right-of-way for State Route 10 and a corner to Sangani (DB 1535/P 472); thence with said Sangani for four lines N/ 73 41′ W. 53.51 feet to a 1/2 inch rebar; thence N. 52 35′ W. 214.00 feet to a 1/2 inch rebar in a stump; thence N. 1 54′ W. 39.29 feet to an iron stake (found); thence S. 89 05′ W. 845.47 feet to a 1/2 inch rebar; on top of ridge, a corner to Gharib (DB 1870/P 444) and Poca River Associates LTD (DB 1994/P 687); thence with said Poca River Associates LTD and top of ridge for two lines N. 12 22′ W. 208.74 feet to a 1/2 inch rebar; thence N. 17 34′ E. 155.25 feet to a 1/2 inch rebar; thence S. 84 15′ E. 867.51 feet to a 1/2 inch rebar; thence S. 70 10′ E. 267.31 feet to a 1/2 inch rebar in the west line of a 30 foot right-of-way for State Route 10; thence with said right-of-way for three lines S. 10 39′ E. 125.54 feet to a 1/2 inch rebar; thence S. 10 31′ W. 72.52 feet to a 1/2 inch rebar; thence S. 21 23′ W. 161.49 feet to the point of beginning, containing 8.17 acres, more or less, as shown as Parcel No. 1 upon a map entitled “Plat Showing Survey of 15.63 Acres Tract owned by W.A. and R.B. Basham located off WV Route 10, Union District, Kanawha County, WV”, dated October 1988, made by T.J. Lumadue, P.E., said map being of record in the office of the County Commission of Kanawha County, West Virginia in Map Book 47, at page 45. Being part of the same property conveyed unto Larry G. Templeton and Ruth H. Templeton, husband and wife, by that deed dated October 30, 1995, from Jennifer West Burch and Mark Burch, wife and husband, and of record in the office of the Clerk of Kanawha County, West Virginia, in Deed Book 2375, at page 185. There is hereby EXCEPTED and RESERVED from this conveyance a 0.32 Acre tract from Larry G. Templeton and Ruth H. Templeton to Kevin McGraw and Lisa R. McGraw, which deed is of record in the aforesaid Clerk’s Office in Deed Book 2646, at page 297. The said out-conveyance is more particularly bounded and described as follows: All that certain lot, tract, or parcel or land, together with the improvements thereon and the appurtenances thereunto belonging, situate on Doc Bailey Road, WV Route 10 (formerly Clay Bank Branch Road) , Union District, Kanawha County, West Virginia, and more particularly bounded and described as follows: BEGINNING at a 5/8″ rebar situate in the easterly right of way line of Doc Bailey Road, said point being further located in the common division line between the real estate herein conveyed and that certain parcel of real estate now or formerly owned by Kevin A. McGraw as described by that certain deed of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in deed Book 2632 at page 436; thence running with the easterly right of way line of Doc Bailey Road S. 10 38′ 40″ E. 73.00 feet to a 5/8″ rebar; thence N. 71 28′ 50″ W. 221.11 feet to a 5/8″ rebar; thence N. 4 40′ 03″ E. 70.44 feet to a 5/8″ rebar situate in the aforesaid common division line; thence running with the aforesaid common division line S. 70 10′ 07″ E. 202.45 feet to the place of Beginning, containing 0.32 Acres, and being the same real estate set forth and designated on the aforesaid map entitle “A Plat Showing a Survey of a 0.32 Acre Parcel of Land to be Severed From a Larger Tract Owned by Larry G. Templeton, Deed Book 2375, page 185. Being Situate in Union District, Putnam County, West Virginia” said map dated October 6, 2005, made by Donald R. Hayes, P. L. S. #902, a copy of said map being attached to that certain deed of record in the aforesaid Clerk’s Office in Deed Book 2646, at page 297. This conveyance is made subject to any and all covenants, restrictions, easements, and reservations which may be a matter or record in the Clerk’s office aforesaid and running with the land. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 5301 Doc Bailey Road, Cross Lanes, WV 25313. AND BEING the same real estate which was conveyed to Kevin C. Forsbrey and Michele Guthrie a/k/a Michele Forsbrey, by Deed dated August 13, 2007, from Larry G. Templeton and Ruth H. Templeton, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2697, at Page 620 and was later conveyed to Kevin C. Forsbrey, by Deed dated June 9, 2017, by Michele Denise Miller, f/k/a Michele D. Forsbrey and also f/k/a Michele D. Gutherie, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2975, at Page 450. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
