NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 10, 2020, executed by Borrower(s), Brandon Stowers, to Marc J. Slotnick, Resident of Kanawha County, WV, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4430, at Page 445. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 118 Streamview Dr, Elkview, WV 25071. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 2, 2025, of record in the Clerk’s Office in Book 4744, Page 893. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 30th day of July, 2025 at 11:00 a.m. ALL that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate near Frame, West Virginia, on the waters of Little Sandy Creek in Elk District, Kanawha County, West Virginia, being part of a 26.72 acre tract of land formerly owned by Ronald and Myrtle Hunt, and also being part of the Bruen`s forty-seven thousand acre tract called “Sheba”. The parcel of land herein described and conveyed being shown upon a certain map or plat entitled, “Plat showing a 0.923 acre 1 lot part of parcel B of the division of a 27 acre tract formerly owned by Ronald and Myrtle Hunt, located on the waters of little Sandy Creek near frame, W. VA surveyed for Tim W. Myers and Barbara J. Myers, Elk District, Kanawha County, W. VA. Scale 1″= 100,” dated January 5, 1983, and prepared by Ralph Adkins, surveyor, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, and being more particularly bounded and described as follows: Beginning at a railroad spike set in the easterly bank of Little Sandy Creek, which point of beginning is further located the following courses and distances from a railroad spike found at the northwesterly corner of parcel “A” as shown on the aforesaid plat, N. 29 56` E. 113 feet and N. 21 35` E.43 feet to the point of beginning; thence from said point of beginning and following the easterly bank of said little creek, N. 21 35`E. 100.68 feet to a railroad spike set in said easterly creek bank; thence, leaving said creek bank and running through a certain 26.27 acre tract of land S.61 44` E. 408.23 feet to a point; thence S.28 16` W. 100.00 feet to a point; thence N. 61 44` W. 396.51 feet to the place of beginning and containing 0.923 of an acre (40,236 Square feet) and designated on said plat as “Parcel B- 1” together with a perpetual easement and certain 40 foot right of way, designated on the aforesaid plat as “new 40-foot R/W” and the existing 40 foot right of way, also designated on said plat as “40`R/W (existing)” for purposes of ingress and egress to and from a certain road known as West Virginia Secondary Route 43 (formerly referred to as Route 41) and the property herein described and conveyed. Parcel Two: All that certain tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Elk District, Kanawha County, West Virginia, on the waters of Little Sandy River (aka Little Sandy Creek) and being part of a 27 acre tract of land which is part of the Bruen`s forty-seven thousand acre tract called “Sheba”, which said lot contains 4.173 acres, more or less, and is described as follows: Beginning at the northwest corner of Lot “B-1” previously mapped, thence N. 21 35` E. 100.68 feet, running with the northerly line of the Myers 27 acre tract, said line also running with Little Sandy Creek to a point; thence S. 61 44` E. 1011.16 feet, leaving Little Sandy Creek and running through said 27 acre tract to a point in the southerly property line of the Myers 27 acre tract; thence S. 61 20` W. 432.68 feet, running with the southerly property line of the Myers 27 acre tract to a point; thence N.09 23` E. 180.00 feet, running with said Myers 27 acre tract to a point; thence S. 89 26` W 339.00 feet, running with the Myers 27 acre tract to the southerly common corner of Lots “A” and “B-2”; thence N. 28 16` E. 256.00 feet, running with the rear or southerly line of lots “B-2” and “B-1” to the southeasterly corner of lot “B-1”; thence N. 61 44` W. 408.23 feet, running with the easterly line of lot “B-1” to Little Sandy Creek, the place of beginning, containing 4.173 acres, more or less, as shown on that certain plat entitled, “plat showing a parcel of land, part of the Ray and Lois Myers 27 acre tract, situate on Little Sandy Creek, located near frame, West Virginia for Patrick V. and Melinda S. Campbell, Sellers: Ray and Lois Myers, Elk District, Kanawha County, West Virginia, Scale: 1″=150; 07/08/95”, prepared by Ralph Adkins, Jr., License No. 897, State of West Virginia, which is of record in said Clerk`S Office. Together with the perpetual easement and right of way, for purposes of ingress and egress, located near the southwest corner of the Myers & Sons Builders, Inc. tract, running from Route 41 in a northwest direction a distance of two hundred twenty one (221) feet to the property herein conveyed, which said right of way is forty (40) feet wide. Excepted and reserved therefrom is a certain right of way, 40 feet in width, across the westerly end of the property hereinabove described and conveyed, as shown on the aforesaid plat, as means of ingress and egress to and from the residue of the property now or formerly owned by Jonathan L. Pack and Brenda L. Pack and a certain road known as West Virginia Secondary Route 43. Also reserved from the conveyance is one-half (1/2) of all the minerals and mineral substances, and the equal one-half (1/2) of minerals and mineral substances not herein reserved and which is herein conveyed and subject to covenants and stipulations contained in that certain deed of record in said Clerk`s Office in Deed Book 85, at Page 29. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
