NOTICE OF SUCCESSOR TRUSTEES’ SALE OF REAL PROPERTY Notice is hereby given that, by virtue of the authority vested in the undersigned Katie L. Monroe and James M. Davis, as Successor Trustees, by a Deed of Trust made and executed by Eric Cook and Amanda Cook, married, to Alex Ross and Alan Otey, as Trustees, dated February 22, 2010, recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 3706, at Page 680 (the “Deed of Trust”); and the said Katie L. Monroe and James M. Davis, acting as Successor Trustees under and by virtue of a certain Notice of Appointment of Successor Trustees, dated December 6, 2019, and recorded in the aforesaid Clerk’s office in Trust Deed Book 4401, at Page 175; and default having been made in the payment of the note secured by the Deed of Trust, the owner and holder of said note, having elected to treat the whole principal debt secured by the Deed of Trust as immediately due and payable and having requested in writing the sale of the real estate conveyed by the Deed of Trust; NOW, THEREFORE, the undersigned Successor Trustees, having been required so to do by said holder, WesBanco Bank, Inc., will sell the real estate conveyed by the Deed of Trust at public auction, together with Joe R. Pyle Auctions, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, in the City of Charleston, West Virginia, on March 3, 2020, at 2:00 p.m., local time, and which said real estate is more particularly described in the Deed of Trust as follows: ALL those certain lots of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in East Crawford Addition, City of Nitro District, Kanawha County, West Virginia, and being known as Lot Numbers Three (3) and Four (4) in Block “G” of the East Crawford Addition, as shown on map of same recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 6, Page 63, described as follows: BEGINNING at an iron pin at the common corner of Lot 4 and Lot 5, located in the southern most corner of the property herein conveyed; thence N. 75 00′ W. 50 feet to an iron pin; thence N. 15 00′ E. 117.5 feet to an iron pin; thence S. 63 09′ E 51.09 feet to an old fence post; thence S. 15 00′ W. 107 feet to the place of beginning, as being shown on the plat entitled “Plat Showing Lots 3 & 4, Block “G”, 803 1st Avenue, Nitro, W.Va. For Harold D. and Theresa A. Strickland Owner – James E. and Barbara Crow, Union District, Kanawha County, W.Va.” being mapped and surveyed by Ralph Adkins, L.L.S. No. 196 and recorded in the aforesaid Clerk’s Office in Deed Book 1873, page 405. AND BEING the same property conveyed to Eric O. Cook and Amanda L. Cook by deed dated September 16, 2009, from Stephen L. Thompson, Successor Trustee, of record in the Office of the Clerk of the County Commission of Kanawha County in Deed Book 2762, at page 91. At the time of the execution of the Deed of Trust the property address was reported to be: 803 1ST Avenue, Nitro, West Virginia. The above-described real estate will be conveyed by the undersigned Successor Trustees by deed without warranty of any kind, express or implied, and subject to all prior liens, and further subject to all unpaid real estate taxes or assessments, encumbrances and claims in favor of public service districts / municipal sanitary boards, if any, and also further subject to any covenants, restrictions, conditions, reservations, rights of way and easements of record in the aforesaid Clerk’s office and affecting the subject real estate, and without responsibility for or representations as to any items of personal property located thereon; and, any party claiming an interest in any item of personal property is responsible for the removal thereof prior to the date of sale. TERMS OF SALE 1. Ten Percent (10%) nonrefundable down payment required on day of sale along with a Ten Percent (10%) Buyers Premium to be added and due on the day of sale by certified funds with the balance due at closing by certified or cashier’s check, or cancellation of existing indebtedness in the discretion of the Successor Trustees. No financing contingencies and closing to take place within thirty days (30) of the day of sale; 2. Subject to any prior deeds of trust or security agreements of record; 3. Subject to any special assessments or any liens for taxes; 4. The successful bidder shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 5. The above-described real estate will be sold by the undersigned Successor Trustees by auction to the highest bidder subject to the right of the undersigned Successor Trustees to reject all bids if, in their opinion, said bids are inadequate; 6. The owner of the indebtedness secured by the Deed of Trust shall have the right to bid; 7. The above-described real estate will be sold in “AS IS” condition. The sale shall be without representation or warranty of any kind, express, or implied; and 8. Such other terms as may be announced at the time of sale. CONTINUANCE OR ADJOURNMENT OF SALE The undersigned Successor Trustees reserve the right to continue the sale or to adjourn the sale for a time or from time to time without further notice other than oral public announcement at the time and the place of sale as hereinabove set forth or at any continuance or adjournment thereof.
