NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by deed of trust dated the 30th day of November, 2010, signed by Sylvia Kaskay, single, to Robert D. Lewis, State Director of the Rural Housing Service for the State of West Virginia, or its successor agency, and the successors in Office as State Director or Acting State Director, Trustee(s), which said deed of trust is of record in the Office of the Clerk of the County Commission of Mingo County, West Virginia, in Trust Deed Book 427, at page 589, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 10:00 o’clock a.m. on the 18TH DAY OF AUGUST 2025 at the front doors of the Courthouse in Mingo County, West Virginia, the following described real estate: All of that certain lot or parcel of real estate situate, lying and being north of Maple Acres Subdivision, Pigeon Creek of Tug River, Magnolia District, Mingo County, West Virginia, and being more particularly described as follows: PARCEL ONE “Beginning at an iron pin driven approximately 15 feet from the center of U.S. Route 52 just below Florence Varney’s home at Musick, Mingo County, West Virginia; thence running toward the hill in a straight line and up the hill for a distance of 100 feet; thence running left-handed in a straight line down the creek and down U.S. Route 52 for a distance of 125 feet to another iron pin; thence running left-handed back down the hill and toward the road in a straight line for a distance of 100 feet to another iron pin driven approximately 15 feet from the center of U.S. Route 52; thence up Pigeon Creek and back up U.S. Route 52 along side U.S. Route 52 for a distance of 125 feet to the iron pin which marks the place of beginning; the same being a lot fronting along U.S. Route 52 a distance of 125 feet and extending back therefrom for a distance of 100 feet, being a lot 125′ x 100′.” EXCEPTING AND RESERVING that part or parcel of the above described property conveyed to Mason Fields, et ux., which parcel of real estate hereby excepted and reserved was subdivided and conveyed out of the real estate described herein, and the real estate described herein is reduced and diminished by the parcel heretofore conveyed unto the said Mason Fields as aforesaid, and for a particular description of the property which was conveyed out and which is the subject of this reservation and exception, see the deed of record in the aforesaid Clerk’s Office, in Deed Book 237, at Page 131. PARCEL TWO All of that certain lot or parcel of real estate situate, lying and being north of U.S. Route 52 and opposite Lots Nos. 2 and 3 of Maple Acres Subdivision on the waters of Pigeon Creek of Tug River, Magnolia District, Mingo County, West Virginia, and being more particularly described as follows: BEGINNING at a 1-1/2″ Hex. Bolt, found on the northwest corner of a lot belonging to Elzie H. Starr, a corner to the original 1.27 acre parcel sold by Georgia-Pacific; thence with the Elzie M. Starr line, S 16 56′ W 94.77 feet to a point 25 feet north of the centerline of U.S. Route 52 (reference. S 89-57 W 28.80 feet to the corner post of a chain link fence); thence leaving the Elzie M. Starr line, and running north of and parallel to said U.S. Route 52, N 72 37′ W 100.00 feet to a 2″ iron pipe set, two Service Pointers; thence leaving U.S. Route 52, N 16 56′ E 94.01 feet to a 2″ iron pipe set on a steep hillside; thence S 73 04′ E 100.00 feet, passing through a 17″ White Oak at 7.6 feet, to the point of BEGINNING, containing .22 acre, more or less, as the same is shown on a “Plat of Survey for Crown Construction and Renovation Showing 0.22 Acres To Be Conveyed to Elzie M. Starr, Situate on the North side of U.S. Route 52 and Opposite Lot No. 2 of the Maple Acres Sub-Division on the Waters of Pigeon Creek, Magnolia District, Mingo County, West Virginia, Scale 1″ = 100′, May 18, 1992,” prepared by Charles H. Stovers, P.S., Box 430, Oceana, WV 24870, attached hereto and made a part hereof. EXCEPTING AND RESERVING, a part of parcel of the above described property conveyed to Mason and Joyce Fields by a deed of record in Deed Book 237, at Page 131. PARCEL THREE All of that certain lot or parcel of real estate situate, lying and being a part of 1.27 ac. Subdivision by Florence Varney, near Musick, Magnolia District, Mingo County, West Virginia, and being more particularly described as follows: “Beginning at a point on the division line of Ray Starr and Mason Fields, said point being on the northerly right-of-way line of U.S. Route No. 82, thence leaving the line of Route No. 52 and with the division line of Ray Starr and Mason Fields; N 16 S 8′ E – 102.26′ feet to a point n the division line of Georgia Pacific Corporation and being a common corner of Ray Starr and Mason Fields, said point being referenced S 73 04′ W – 125.00′ feet from the northwesterly corner of Starr’s lot, thence along the Georgia Pacific line; N. 73 04′ E – 10.00′ feet to a point, thence leaving the Georgia Pacific line and running into the Mason Fields lot; S 16 58′ W – 102.42′ feet to a point on the northerly right-of-way line of the before mentioned Route No. 52, thence with a northerly line of Route No. 52 having a curve to the right with a radius of 11,459.19′ feet; N 72 18′ 28” W – 10.102′ feet chord to the point of beginning. Being the westerly 10′ feet of Parcel 15.2 to be conveyed by Mason Fields to Ray Starr. Survey map, prepared by Randy Brooks Graco, LLC, WV 756 KY 2812, is of record in the aforesaid Clerk’s office. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above-described real estate is reported to have a mailing address of: RT 2 Box 292, Delbarton, West Virginia 25670 TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third-party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees. Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
