It appearing by the affidavit filed in this action that Petitioners have used due diligence, pursuant to Rule 4(e)(1)(C) of the West Virginia Rules of Civil Procedure, to ascertain the address or whereabouts of Respondents; it is therefore ORDERED that CANDY STARKEY, JAMES STARKEY, and any UNKNOWN HEIRS, SUCCESSORS, AND/OR ASSIGNS OF KENNETH R. STARKEY appear and serve upon J. Mark Adkins, Esq., Bowles Rice LLP, counsel for Petitioners, whose address is 600 Quarrier Street, Charleston, West Virginia 25301, a response or other defense to the Second Amended Petition to Appoint Special Commissioner heretofore filed in this action within 30 days after the first publication of this notice. Otherwise, the Court may render judgment of default against Respondents, at any time thereafter, thereby granting the relief requested by Petitioners in the Second Amended Petition to Appoint Special Commissioner. Pursuant to West Virginia Code 56-3-24 and 59-3-2, a Class II legal advertisement shall be published once a week for two successive weeks in a qualified newspaper in the publication area.
