Pinson, Trustee, for the benefit of Community Trust Bank, Inc., which deed of trust is of record in the Office of the Clerk of the County Commission of Mingo County, West Virginia, in Trust Deed Book No. 419, at Page 575, as amended and completely restated in an Amended and Restated Credit Line Deed of Trust dated December 23, 2019 made by Williamson Renaissance Development Inc. to Charles M. Johnson, Jr., Trustee, for the benefit of Community Trust Bank, Inc., which Amended and Restated Credit Line Deed of Trust is of record in the Office of the Clerk of the County Commission of Mingo County, West Virginia, in Trust Deed Book No. 479, at Page 533, and further amended and completely restated in an Amended and Restated Credit Line Deed of Trust dated October 16, 2023 made by Williamson Renaissance Development, Inc. to Charles M. The above described property is in all respects the same property which was conveyed unto Williamson Renaissance Development, Inc., from Louis Kawaja and Colin Berry, dba L & S Realty, Co., by Deed of Conveyance, dated January 18, 2007, and found of record in the Office of the Clerk of the County Commission of Mingo County, West Virginia in Deed Book 413, at Page 470. TERMS OF SALE: 1. Cash in hand paid on the day of sale. 2. The sale is made “where is, as is” with no warranty whatsoever. 3. The Successor Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 4. Subject to any and all assessments and taxes against said property, and all matters of record in the aforesaid Clerk’s Office senior in priority to the deed of trust under which this sale is being made, including without limitation all prior liens and encumbrances of any nature whatsoever, including, without limitation, the liens for ad valorem taxes assessed against the property. 5. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 22 of Chapter 11 of the West Virginia Code. 6. If the sale is set aside, the purchaser at such sale may be entitled to only a return of the amount paid less any applicable fees and costs and shall have no further recourse against the Successor Trustee, the Beneficiary, or any other person or entity. 7. The Successor Trustee reserves the right to offer the above-described Parcels 1&2, 3, 5, 6 and 7 separately and to contingently accept the highest bids thereon. Thereafter, bids may be taken on the above parcels as a single unit and the highest bid contingently accepted. After the offering of said property as hereinabove provided, the bid or bids submitted will be accepted in a manner that will result in the highest total price for all such property. In the event that the bid accepted is the bid for the property as a single unit then the successful bidder shall designate which portion of such bid is attributable to which parcel. The Successor Trustee further reserves the right to only sell certain parcel(s) if a bid is in an amount sufficient to satisfy the expenses of the sale and all indebtedness secured by the Deed of Trust is obtained for less than all the parcels. 8. The sale does not include Parcel 8 (Animal Rescue Property) described in the Deed of Trust, and the Deed of Trust continues in effect as to said Parcel 8.
