TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vesting in it by that certain Deed of Trust recorded on February 8, 2006, in the Office of the Clerk of the County Commission of Lincoln County, West Virginia, in Book 184 at Page 643, Joe Caudill and Lisabeth Caudill did convey unto Carl H. Cather, III, Esq, as Original Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Elk River Trustees Inc., as Substitute Trustee by virtue of a Substitution of Trustee recorded on January 7, 2026, in Book 307 at Page 338 in the aforesaid Clerk’s Office; the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said Deed of Trust to sell the real estate described below, as there has been a default under the terms and conditions of said Deed of Trust. Therefore, the undersigned Substitute Trustee having been instructed by NewRez, LLC d/b/a Shellpoint Mortgage Servicing to foreclose thereunder will offer for sale, at a public auction at the front door of the Lincoln County Courthouse in Hamlin, West Virginia, on February 3, 2026 at 1:30 PM the following described real estate, together with its easements, improvements, and appurtenances thereunto belonging, situate in Duval District, Lincoln County, West Virginia, and more particularly bounded and described as follows: LEGAL DESCRIPTION All of the following described tracts of land situate on the waters of Peter Cave Fork of Big Horse Creek in Duval District, Lincoln County, West Virginia, which are more particularly bounded and described as follows: TRACT ONE: Beginning at the call of gum and Spanish oak, corner of a survey of 121 acres made for Samuel S. Stone, April 5, 1885; thence with the same S. 81 E. 95 poles to two small chestnut oak sprouts near the top of a point; thence leaving the line of the 121 acre survey S. 43-1/2 E. 42 poles to a maple on the southeast side of the creek, by a rock cliff; N. 70 E 30 28-1/2 poles to a gum on a hillside; 20 (30) W. 68 poles to a hickory and yellow lin at the call of an oak; at the call of a hickory and a yellow lin on a ridge; thence out the ridge S. 54 (30) W. 13-4/5 poles to a fallen white oak on a ridge about 1/2 N.W. center of the ridge at or near the call of a white oak on the ridge, pointers marked on five small hickories and locust; thence down a hill N. 25 W. 46 poles to a beech standing on a point standing between two drains; thence up the creek S/ 60-1/2 W. 41 poles to a sulphur spring; N. 47 (15) W. 104 poles to a dogwood and two fallen white oaks a corner to the 121 acre survey of Samuel S. Stone; thence N. 33 (45) E. 31 poles to the place of beginning, containing 50-3/16 acres more or less. TRACT TWO: Beginning on a small hickory on a knob; thence with the fence to where the line crosses the ridge to a stake it being a locust stake, and containing one (1) acre, more or less. There is hereby reserved from the operation of this deed a small tract of real estate bounded and described as follows: Beginning on a gum corner to P.G. Harless’ survey; thence with said survey S. 20 W. 11 poles to a small poplar; thence a northwesterly direction about 8 poles to a stake in the edge of the county road; thence N. 70 E. 80, 13 poles to the beginning containing 3/l0th of an acre more or less. And being the same property conveyed unto Joe Thomas Caudill, by Lisabeth Caudill, by deed dated July 8, 1993 and is recorded in the Office of the Clerk of the County Commission of Lincoln County, West Virginia, in Deed book 266, at page 285. At the time of the execution of the subject Deed of Trust, the property was reported to have an address of: 294 Wolf Den Branch, Alkol WV 25501 The above referenced real estate will be conveyed with no covenants of warranty and subject to any and all easements, rights of way, conditions, covenants, restrictions, exceptions, reservations, leases and other servitudes, which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground. The sale of the referenced real estate will also be subject to all prior liens and including any and all other deeds of trust, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the subject Deed of Trust. The subject property will be sold in an “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. In the event that there are federal tax liens against the property, the United States has the right to redeem the property within a period of one hundred twenty (120) days from the date of the sale. The Substitute Trustee reserves the right to adjourn the sale for a time, or from time to time, without further notice, by announcement at the time and place of the foreclosure sale described herein. TERMS OF SALE 1. $4,000.00 (Four Thousand Dollars) in cash and/or certified funds made payable to “Elk River Trustees, Inc.” due as a deposit at the time of sale, with the balance due and payable within thirty (30) days of sale. Personal checks will not be accepted. 2. The purchaser at the sale shall be responsible for payment of all real estate taxes. 3. The purchaser shall be responsible for payment of the recording cost of the deed and also for payment of the tax on the privilege of transferring the real property (transfer tax) imposed by West Virginia Code 11-22-2. 4. The parties secured by the Deed of Trust reserve the right to purchase the property at the foreclosure sale.
