In the Circuit Court of Wayne County, West Virginia Case No. CC-50-2026-C-5 Judge James Young Rena Chapman, Paula Chapman McCagg, Plaintiffs, v. Midville Heights Property Owners Association, Defendant Order of Publication Plaintiff seeks to quiet title and establish as an absolute title in fee simple that certain piece and parcel of land situate in Wayne County, which more fully and particularly described as follows: That certain tract or parcel of real estate situate in Union District, Wayne County, West Virginia, as shown on Plat of Midville heights of record in the office of the Clerk of County Commission of Wayne County, West Virginia, in Map Book No. 5, at Page 52, as he eastern half of Lot No. (39), made specifically described as follows: BEGINNING at the southeast corner of Lot #39; thence running N. 13 56′ E. 89.02 ft. to the northeast corner of Lot 39; thence running N. 76 04′ W. 35 feet to a point; thence running S. 13 56′ W. (severing Lot #39) 90 feet, more or less, to a point on the southerly line of Lot 39; thence running S. 79 E. approximately 35 feet to the place of beginning, containing .075 acre. Being part of the property as conveyed to Midville Heights Property Owners Association, a West Virginia non-profit corporation, from B. & E. Development, Inc., a West Virginia corporation, by Deed dated March 30, 1982, and of record in the aforesaid Clerk’s office in Deed Book No. 484, at Page 254. It appearing by an affidavit of record in this civil action that the Plaintiff has used due diligence to ascertain the whereabouts of the Defendant, without success, it is hereby ORDERED, that Defendant named hereinabove serve upon W. Spencer Conley, Plaintiff’s attorney, whose address is 1002 Third Avenue, P. O. Box 1835, Huntington, West Virginia 25719, an answer or other defense to the Complaint initiating this civil action on or before the 16th day of February, 2026, otherwise judgement by default will be taken against Defendant at any time thereafter. A copy of said Complaint can be obtained from the Wayne County Circuit Clerk, located in Wayne, Wayne County, West Virginia.
