IN THE 9th CIRCUIT COURT OF BOONE AND LINCOLN COUNTIES, WEST VIRGINIA ADMINISTRATIVE ORDER Proclamation of Election to Fill Tenth Family Court Circuit Judge Vacancy Upon the retirement of Honorable Judge, Bobby R. Hale, a vacancy occurred for the office of Family Court Judge of the 10th Family Circuit, sitting in Boone County, West Virginia. On a prior date the Honorable Patrick Morrisey, Governor of the State of West Virginia, appointed an eligible person to fill that vacancy, who will remain in office until a successor is duly elected and certified, in accordance with the applicable provisions of W.Va. Code 3-10-3(d)(2). In as much as the unexpired term for that vacancy had more than three years remaining and the vacancy occurred before the close of the candidate filing period for the primary 2026 election, the vacancy for the remainder of the unexpired term for the office of Family Court Judge for the 10th Family Circuit, sitting in Boone County, West Virginia, must be filled by a nonpartisan judicial election held concurrently with the primary election in 2026. ld. NOW THEREFORE BE IT PORCLAIMED, that the undersigned Chief Judge of the 9th Judicial Circuit, comprising Boone and Lincoln County, West Virginia, pursuant to the authority of W. Va. Code 3-10-1(c)(3) and 3-10-3(b) hereby ORDERS the following: l. That the vacancy for the unexpired term for the Family Court Judge of the 10th Family Circuit, sitting in Boone County, West Virginia, shall be filled by a nonpartisan judicial election to be held concurrently with the primary election on May 16, 2026; and, 2. That the Clerk of the Boone County Commission and the Clerk of the Lincoln County Commission shall cause a notice of such election to be published prior to the election as a Class 1-O legal advertisement in compliance with the applicable provisions of W. Va. Code 59-3-2(b) and the publication area shall include the counties of Boone and Lincoln, West Virginia. W. Va. Code 3-10-l (e); and, 3. The candidate filing period for the vacancy of the Family Court Judge of the 10th Family Circuit, sitting in Boone County, West Virginia, shall start on January 12, 2026, and end on January 31, 2026; and, 4. Any qualified person desiring to become a candidate for office must timely file a Certificate of Announcement with and pay the statutory filing fee of $1,039.50 to the Secretary of State of West Virginia.
