In the Circuit Court of Boone County, West Virginia Case No. CC-03-2025-C-108 Judge Stacy L. Nowicki-Eldridge Wells Fargo Bank, N.A., Plaintiff, v. Linda Woodard, Mark Dunlap, Tammy Dunlap, Phillip Wade Bowman, Tori Leigh Thomas ET AL, Defendants ORDER OF PUBLICATION CIRCUIT COURT OF BOONE COUNTY, WEST VIRGINIA ORDER OF PUBLICATION IN THE MATTER OF: Wells Fargo Bank, N.A. v. Linda Woodard, Phillip Wade Bowman, Tori Leigh Thomas, Mark Dunlap, and Tammy Dunlap, Civil Action No. 25-C-108. Based on the Plaintiff’s Motion for Order of Publication and the exhibits thereto, including an affidavit of Plaintiff’s counsel and a letter from Plaintiff’s process server, the Court is satisfied that that Plaintiff has used due diligence to ascertain the whereabouts of Linda Woodard. However, such due diligence was without effect. Thus, service by publication is hereby ORDERED. There is now pending in the Circuit Court of Boone County, West Virginia the civil action captioned Wells Fargo Bank, N.A. v. Linda Woodard, Phillip Wade Bowman, Tori Leigh Thomas, Mark Dunlap, and Tammy Dunlap, Civil Action No. 25-C-108. Pursuant to Plaintiff’s Complaint, Plaintiff commenced this action seeking declaratory judgment as to whether a Modified Deed of Trust created a security interest in an easement benefiting Linda Woodard; and (2) whether the security interest created is to the benefit of Wells Fargo. Accordingly, it is hereby ORDERED that the Defendant, Linda Woodard, must appear and serve upon the Plaintiff’s counsel, H. Hampton Rose IV of the law firm Steptoe & Johnson PLLC, whose address is P.O. Box 1588 Charleston, WV 25326-1588 an Answer or other response to Plaintiff’s Complaint within thirty (30) days after the date of the first publication of this notice; otherwise, judgment by default or other adverse ruling may be rendered against Linda Woodard at any time thereafter.
