GREEN, UNKNOWN PERSONS/OWNERS, AND RANDALL WHITE, SHERIFF OF BOONE COUNTY, WEST VIRGINIA Notice is hereby given to Kevin M. Green, Mary C. Green, Unknown Persons/Owners, and Randall White, Sheriff of Boone County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that, pursuant to W. Va. Code 54-1-1, et seq., and 54-2-1, et seq., and all applicable West Virginia statutes, a hearing to determine just compensation will be held on April 15, 2026, at 9:00 a.m., in this action in the Circuit Court of Boone County, West Virginia, before Judge Stacy L. Nowicki-Eldridge in relation to a Petition for Condemnation/Right of Entry, which was filed and granted in the Circuit Court of Boone County, West Virginia, and is known as Civil Action No. 18-C-124, and styled Appalachian Power Company vs. Kevin M. Green, et al. Said just compensation hearing will address real property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate on the waters of Toney’s Branch, in Sherman District, Boone County, West Virginia, identified as Tax Map 4, Parcel 118, and recorded in the office of the Clerk of the County Commission of Boone County, West Virginia, in Deed Book 221, at page 46, and being more particularly described as follows: BEGINNING at a sycamore at the state highway on Toneys Branch, a corner to Lot No. 1; thence running up the mountain with the line of said Lot No. 1, S. 63 15 E. 1310 feet to a stake, also a corner to Lot no. 1; thence 86 E. with exterior line of said tract of land a distance of 240 feet to where one stood 3 chestnuts; thence down the mountain N. 45 30 W. 1430 feet to a stake back of the one half acre reservation held in original deed, down the creek 100 feet; thence N. 59 30 W. 100 feet with the line of said one half acre reservation to the state highway; thence down with the right of way of said highway line S. 31 30 W. 295 feet to the place of BEGINNING, containing 8.4 acres, the same being more or less. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Boone County Circuit Clerk’s office at 200 State Street, Madison, West Virginia, 25130. The said Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Jeffrey A. Kimble, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that you may appear for hearing and presentation of evidence, and are notified that any failure to appear and/or present evidence may result in the waiver of any and all defenses or claims, if any, you may have regarding just compensation or otherwise in this action.
