The property to be condemned for the purpose aforesaid is situated in Mingo County, West Virginia, and is described as follows: TRACT 1 – NONCONTROLLED ACCESS RIGHT OF WAYBEGINNING at a point in the division line between James Todd Hatfield and Terri Hatfield, and Unknown Owner, said point being in the southern existing right of way line of Mingo County Route 13 (CR 13) and 17 feet radially right of relocated CR 13 (Gilbert Creek Connector) centerline at Station 1387+85, Project U330-52-39.70 05, NHPP-0052(342)D, Sec. 2, Mingo County, West Virginia;thence, northeasterly, meandering with said existing right of way line 767 feet, more or less, to a point in the western existing Norfolk Southern Railroad right of way line, said point being 15 feet radially right of centerline at Station 1395+59; thence, southeasterly, with said existing railroad right of way line 24 feet, more or less, to a point in the southern proposed noncontrolled access right of way line of relocated CR 13, said point being 29 feet radially right of centerline at Station 1395+39; thence, southwesterly, with said proposed noncontrolled access right of way line 74 feet, more or less, to a point 27 feet radially right of centerline at Station 1394+59; thence, southwesterly, continuing with said proposed noncontrolled access right of way line 95 feet, more or less, to a point 27 feet radially right of centerline at Station 1393+59;thence, southwesterly, continuing with said proposed noncontrolled access right of way line 72 feet, more or less, to a point 28 feet radially right of centerline at Station 1392+84;thence, southwesterly, continuing with said proposed noncontrolled access right of way line 72 feet, more or less, to a point 27 feet radially right of centerline at Station 1392+08;thence, southwesterly, continuing with said proposed noncontrolled access right of way line 49 feet, more or less, to a point 27 feet right of and at right angle to centerline at Station 1391+59;thence, southeasterly, continuing with said proposed noncontrolled access right of way line 13 feet, more or less, to a point 40 feet right of and at right angle to centerline at Station 1391+59;thence, southwesterly, continuing with said proposed noncontrolled access right of way line 78 feet, more or less, to a point 39 feet right of and at right angle to centerline at Station 1390+81;thence, southeasterly, continuing with said proposed noncontrolled access right of way line 14 feet, more or less, to a point 52 feet right of and at right angle to centerline at Station 1390+77;thence, southwesterly, continuing with said proposed noncontrolled access right of way line 34 feet, more or less, to a point 54 feet right of and at right angle to centerline at Station 1390+44;thence, westerly, continuing with said proposed noncontrolled access right of way line 20 feet, more or less, to a point 39 feet right of and at right angle to centerline at Station 1390+31;thence, southwesterly, continuing with said proposed noncontrolled access right of way line 31 feet, more or less, to a point 25 feet right of and at right angle to centerline at Station 1390+03; thence, southwesterly, continuing with said proposed noncontrolled access right of way line 77 feet, more or less, to a point in the division line between James Todd Hatfield and Terri Hatfield, and Unknown Owner, said point being 31 feet radially right of centerline at Station 1387+85;thence, northwesterly, with said division line 14 feet, more or less, to the place of beginning and containing 12,197 square feet, more or less.TRACT 2 – PERMANENT DRAINAGE EASEMENTBEGINNING at a point in the eastern proposed permanent drainage easement line of relocated Mingo County Route 13 (CR 13), said point being in the southern proposed noncontrolled access right of way line of relocated CR 13 (Gilbert Creek Connector) and 54 feet right of and at right angle to relocated CR 13 centerline at Station 1390+44; Project U330-52-39.70 05, NHPP-0052(342)D, Sec. 2, Mingo County, West Virginia;thence, northeasterly, with said proposed noncontrolled access right of way line 34 feet, more or less, to a point in the eastern proposed permanent drainage easement line, said point being 52 feet right of and at right angle to centerline at Station 1390+77;thence, southeasterly, with said proposed permanent drainage easement line 23 feet, more or less, to a point 75 feet right of and at right angle to centerline at Station 1390+77;thence, southeasterly, continuing with said proposed permanent drainage easement line 25 feet, more or less, to a point in the western existing Norfolk Southern Railway right of way line, said point being 101 feet right of and at right angle to centerline at Station 1390+69;thence, southwesterly, with said existing railroad right of way line 25 feet, more or less, to a point in the eastern proposed permanent drainage easement line, said point being 99 feet right of and at right angle to centerline at Station 1390+44;thence, northwesterly, with said proposed permanent drainage easement line 23 feet, more or less, to a point 77 feet right of and at right angle to centerline at Station 1390+51;thence, westerly, continuing with said proposed permanent drainage easement line 23 feet, more or less, to the place of beginning and containing 1,271 square feet, more or less.The above-named Respondents are hereby notified: 1. that the above-styled condemnation proceeding was instituted in the Circuit Court of Mingo County on or about March 30, 2026, to take and appropriate the above-described property for the purposes aforesaid; 2. that you may serve upon Petitioner’s Counsel (Tonya Shuler of Litchfield Cavo LLP, 8 Capitol Street Floor 4, Charleston, West Virginia 25301) an answer to the Petition filed herein; 3. that a copy of the Petition may be obtained from the Clerk of the Circuit Court of Mingo County;
