RUTHERFORD, SHERIFF OF KANAWHA COUNTY, WEST VIRGINIA Notice is hereby given to Jason R. Clark, Hannah J. Clark aka Hannah Jacoba Jordon, Unknown Persons/Owners, and Michael Y. Rutherford, Sheriff of Kanawha County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”) that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Kanawha County, West Virginia, and is known as Civil Action No. 20-P-33, and styled Appalachian Power Company vs. Jason R. Clark, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate on the water of Trace Fork of Davis Creek, Jefferson District, Kanawha County, West Virginia, and identified as Tax Map 18, Parcel 004, and recorded in Deed Book No. 3051, at page 125, in the office of the Clerk of the County Commission of Kanawha County, West Virginia, and bounded and described as follows: PAR A 33-80/100 M/L Trace FK BEGINNING for reference at a point located at the most northerly common corner of the William Lee and Rosalie Glenn tract and a 33.8036 acre parcel now owned or to be conveyed to Edison Lude, et ux, which is shown and set out on a map entitled “Map Showing Survey of Parcels A, B, & C of The Carl Lude Property Located in Jefferson District, Kanawha County, West Virginia, dated October 30, 1979, Scale 1” = 100′, attached to that certain deed of record in the aforementioned Office of the Clerk in Deed Book 2013, at page 651 as Exhibit “A”; thence N. 13 15′ W. 100 feet to the true point of beginning, which point is an iron pin at the easterly terminus of the division line between Parcels A and B as shown on said map; thence from said true point of beginning, N. 68 28′ W. 144.10 feet to a point; thence S 73 42′ W. 100 feet a point; thence S. 55 10′ W. 220 feet to a point; thence S. 38 15′ W. 220 feet to a point; thence S. 63 25′ W. 454.77 feet to an iron pin in the drain into Trace Fork; thence continuing in a general direction up said drain, S. 33 14′ W. 134.61 feet to an iron pin; thence S. 63 54′ W. 660 feet to an iron pin; thence S. 45 08′ W. 485.75 feet to an iron pin; thence S. 04 03′ W. 421.79 feet to an iron pin lying in the line of a tract now owned by Ralph R. Ashley and at the southwestern terminus point of the division line between Parcels A and B as shown on the said map; thence with the Ashley line, N. 67 00′ W. 890.56 feet to a point; thence N. 50 35′ E. 497 feet to a point; thence N. 5 30′ W. 278 feet to a point; thence N.38 05′ E. 332 feet to a point; thence N. 72 50′ E. 428 feet to a point; thence N. 37 55′ E. 490 feet to a point; thence N. 64 30′ E. 811 feet to an iron pin; thence N. 34 30′ E. 94 feet to a point; thence N. 51 00′ E. 144 feet to a point; thence N. 60 00′ E. 248 feet to a point; thence N. 63 55′ E. 270 feet to a point; thence N. 45 15′ E. 178 feet to a point lying in the westerly line of a .732 acre parcel now owned by Delmer Lude and Helen Lude, which .732 acre parcel is shown and outlined in green upon a map entitled “Map of Three Acres Severed From Lands Owned: Carl Lude (Deceased) and Faye Lude, “Widow”, dated May 1, 1980, prepared by Carl Kinder, Sr., and attached to that certain deed of record in Deed Book 2013, at page 651 as Exhibit “B”; thence with said line, S. 13 15′ E. 265 feet to an iron pin and the true place of beginning, and containing 33.8028 acres, more or less, and being Parcel A on the aforementioned Map Showing Survey of Parcels A, B, & C of the Carl Lude Property. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Kanawha County Circuit Clerk’s office at 111 Court Street, Charleston, West Virginia, 25301, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on March 27, 2020, at 11:00 a.m., in the Circuit Court of Kanawha County, West Virginia, located at 111 Court Street, Charleston, West Virginia, 25301, before the Honorable Carrie L. Webster. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
