TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated July 17, 2014, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed of Trust Book 2538, at Page 84 and rerecorded in Deed of Trust Book 2539, at Page 617, Victoria M. Nester did convey unto J. Patrick Jones, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Cabell County Courthouse, in Huntington, West Virginia, on March 18, 2020, at 1:15 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Gideon District, Cabell County, West Virginia, and more particularly described as follows: All that certain lot, piece or parcel of land situated in the City of Huntington, Cabell County, West Virginia, known and designated on a Map of Hildacrest, a copy of which map was filed in the Cabell County Court Clerk’s Office on September 27, 1919 in Map Book 2, as Map 21, as Lot No. 51, and being more particularly described as follows:: BEGINNING at a point in the South line of Crestmont Drive at the corner between Lots 50 and 51 as shown on map; thence with said line of Crestmont Drive southeasterly 50 feet to the corner between Lots 51 and 52; thence with the line between the said Lots southwesterly 175 feet, more or less, to a point in what is now the north line of Crestmont Drive; thence with the said line northwesterly 65 feet, more or less, to the southerly corner between Lots 50 & 51; thence with the said line between said lots northeasterly 135 feet, more or less, to the point of BEGINNING, EXCEPTING, HOWEVER, that certain parcel containing 3,450 square feet, more or less, conveyed to the State Road Commission of West Virginia, a corporation, by Deed dated July 22, 1965, recorded in the Cabell County Court Clerk’s Office in Deed Book No. 633, at Page 568, described as follows: BEGINNING at a point in the corner of Lot 51 and 52 in the existing East right-of-way line of Crestmont Drive 81 feet left of and at right angles to the center line station 81 + 67; thence with the existing east right of way line with Crestmont Drive northerly 65 feet, more or less, to the corner of Lot 51 and 50, 102 feet left of and at right angles to the center line station 81 + 07; thence with the division line between Lot 51 and 50 northeasterly 45 feet, more or less, to a pint in the North controlled access right-of-way line 145 feet of and at right angled to centerline station 80 + 93; thence with the North controlled access right-of-way line Southeasterly 50 feet, more or less, to a point in the division line between Lot 51 and 52, 163 feet left of and at right angles to center line station 81 + 40; thence with a division line between Lot 51 and Lot 52, southwesterly 86 feet, more or less, to the place of beginning. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1617 Crestmont Dtive , Huntington, WV 25701. AND BEING the same real estate which was conveyed to Victoria M. Nester by Deed dated June 5, 2014, from Ira D. Batram and Jane T. Bartram, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 1309, at Page 551. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
