TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated September 24, 2001, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed of Trust Book 1703, at Page 282, Roger D. Hatfield did convey unto Robert R. Harpold, Jr. and John R. Lukens, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Cabell County Courthouse, in Huntington, West Virginia, on March 18, 2020, at 1:17 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the McComas District, Cabell County, West Virginia, and more particularly described as follows: All that certain lot, piece or parcel of land situate in McComas District, Cabell County, West Virginia, on the waters of the right fork of Heath Creek, a tributary of the Guyandotte River, and located on a private right of way for the Merritt Subdivision, approximately 0.1 miles North of its junction with West Virginia State Route Ten, and being more particularly described as follows: BEGINNING at a rebar (set) on the west side of a 20 foot right of way for the said Keith Merritt Subdivision and also being the northeast corner of Parcel Four, thence leaving the road South 87 00′ 45″ West, a distance of 103.25 feet to the rebar (set); thence North 01 41′ 13″ East, a distance of 210.81 feet to a rebar (set); thence North 88 51′ 05″ East, a distance of 262.20 feet to a rebar (set) at a point of intersection with a non-tangent curve, concave Northwesterly, having a radius of 64.58 feet and a central angle of 24 10′ 09″, thence Southerly along the arc of said curve to the right, from which the local tangent at the beginning point bears South 13 00′ 21″ West, a distance of 27.24 feet, said arc subtended by a chord which bears South 25 05′ 25″ West, a distance of 27.04 feet to the point of intersection with a tangent line; thence South 37 10′ 30″ West, a distance of 96.20 feet to a rebar (set) at a point of intersection with a tangent curve, concave Easterly, having a radius of 90.00 feet and a central angle of 40 09′ 45″, thence Southwesterly along the arc of said curve to the left, from which the local tangent at the beginning point bears South 37 10′ 30″ West, a distance of 63.09 feet, said arc subtended by a chord which bears South 17 05′ 37″ West, a distance of 61.80 feet to the point of intersection with a tangent line; thence South 02 59′ 15″ East, a distance of 46.27 feet, to the BEGINNING, containing 0.982 acres, or 42,797.467 square feet of land, more or less, as shown on the platy attached to the Deed recorded in Deed Book 1015, at Page 501. TOGETHER WITH a 20 foot easement for the purposes of ingress and egress through the said Subdivision and a 15 foot easement across and through the Rayburn property to West Virginia State Route Ten. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 5104 Route 10, Barboursville, WV 25504. AND BEING the same real estate which was conveyed to Roger D. Hatfield by Deed dated September 24, 2001, from Keith Merritt, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 1084, at Page 531. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
