TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 31, 2007, and duly recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Document No. 312979880, in Book No. 657, at Page 919, Douglas Mark Billups did convey unto Philip Hereford, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated May 16, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Bayview Loan Servicing, LLC, to foreclose thereunder, will offer for sale at public auction at the front door of the Wayne County Courthouse in Wayne, West Virginia, on August 6, 2019 at 11:30 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Stonewall District, Wayne County, West Virginia, and more particularly described as follows: All that certain lot or parcel of real estate situate on the Right Fork of Beech Fork, Stonewall District, Wayne County, West Virginia, and being more particularly described as follows: Beginning at an iron pin (set) in the westerly right of way of Local Service Route 26 corner to the lands of Elihu Lester, et ux (Deed Book 201, Page 267); thence with said Lester S. 83 degrees 52′ W. 281 feet to three black oaks corner to said Lester (Deed Book 346, Page 116); thence S 69 degrees 35′ W. 301 feet to a hickory; N. 59 degrees 02′ W. 198 feet to a hickory; thence N. 62 degrees 30′ W. 219 feet to a double buckeye; thence N. 63 degrees 09′ W. 438 feet to two maples; thence N. 57 degrees 21′ W. 228 feet to a black oak; thence N. 56 degrees 02′ W. 115 feet to a walnut; thence N. 80 degrees 39′ W. 166 feet to a maple corner to said Lester (Deed Book 406, Page 311); thence S. 28 degrees 46′ W. 58 feet to a hickory; thence S. 80 degrees 56′ W. 679 feet to a walnut; thence S. 2 degrees 36′ E. 66 feet to a white oak corner to Willard Perry, et ux, (Deed Book 346, Page 259); thence with said Perry S. 73 degrees 09′ E. 1,584 feet to a hickory; thence severing the lands of Emual Adkins, et ux, (Deed Book 461, Page 163) S. 83 degrees 29′ E. 176 feet to a white oak; thence S. 60 degrees 45′ E. 876 feet to an iron pin (set) in said right of way; thence with said right of way N. 0 degrees 37′ E. 651 feet to the beginning, containing NINETEEN and TWELVE ONE-HUNDREDTHS (19.12) ACRES. The parties of the first part do further GRANT unto the parties of the second part any and all rights they may have in an easement for vehicular ingress and egress from the public road to the property conveyed herein, which easement is to be of sufficient width and to be located on the land which is nearly level adjoining the southwesterly portion of the land herein conveyed for a length of about 70 feet. All that certain lot or parcel of real estate situate on Shingle Branch of the Right fork of Beech Fork, Stonewall District, Wayne County, West Virginia, and being more particularly described as follows: Beginning at IP in the westerly line of Local Service Route 26 (right fork of Beech Fork Road) corner to the lands formerly owned by Lester (Deed Book 201, Page 267); thence leaving said right of way and with Lester, S. degrees 52′ W. 281 feet to 3 black oaks; thence S. 69 degrees 35′ W. 301 feet to a hickory; thence severing the lands of the grantor herein down the hill, S. 73 degrees 32′ E. 582 feet to a point in said Route 26; thence N. 00 degrees 37′ E. 300 feet to the beginning, containing TWO and ONE HUNDRED SIXTY-EIGHT ONE-THOUSANDTHS (2.168) ACRES, more or less. At the time of the execution of the Deed of Trust, this property was reported to have an address of: RR 1 Box 172, East Lynn, WV 25512. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $7000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
