TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 2, 2010, and duly recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Document No. 313015108, in Book No. 696, at Page 840, Robert S Cantrell and Linda G Cantrell did convey unto BB&T Collateral Service Corporation, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated June 10, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Branch Banking and Trust Company to foreclose thereunder, will offer for sale at public auction at the front door of the Wayne County Courthouse in Wayne, West Virginia, on August 13, 2019 at 11:30 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Lincoln District, Wayne County, West Virginia, and more particularly described as follows: That certain lot, piece or parcel of real estate, including all improvements thereupon, locate and situate in Wayne County, West Virginia, to-wit: Beginning at an iron pin (set) in the North right-of-way line of Bull Creek Road – Right Fork, (State Local Service Route 428), and at the Southeast corner of Delbert Crum, (D.B. 470, Pg. 243); thence, leaving said road and up the hill with Crum, N. 9 08′ W. 677.48 feet to a 12-inch hickory on the ridge; thence, continuing with Crum up said ridge, N. 28 14′ E. 227.12 feet to a 14-inch black oak, N. 26 49′ E. 228.34 feet to a 12-inch hickory on top of a knob at the corner of William Little, Jr. (D.B. 451, Pg. 370); thence, leaving Crum and along the ridge with Little, N. 81 10′ E. 200.61 feet to an 18-inch black oak, N. 68 04′ E. 157.24 feet to an 18-inch black oak at the corner of Randolph Salmons Estate, (D.B. 247, Pg. 284); thence, leaving Little and the ridge, and running down the point with Salmons, S. 18 48′ E. 867.89 feet to an iron pin (set) at the North right-of-way line of Bull Creek Road – Right Fork; thence, leaving Salmons and with said right-of-way line, S. 77 04′ W. 47.90 feet, S. 69 33′ W. 87.50 feet, S. 49 39′ W. 110.48 feet, S. 43 06′ W. 190.10 feet, S. 58 23′ W. 69.68 feet, S. 83 00′ W. 45.75 feet, N. 76 18′ W. 91.87 feet, S. 80 49′ W. 53.55 feet, S. 66 16′ W. 149.65 feet to the point of beginning, containing Fourteen and Fifty-Six One Hundredths (14.56) acres, more or less, as shown on a plat of the real estate hereby conveyed. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 565 Right Fork Of Bull Creek Road, Crum, WV 25669. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
