NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 18th day of December, 2014, Jody D. Foster and Judy Carrol Foster, Grantors, to P. Andrew Vallandingham and Samuel Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2556 beginning at page 335, and the undersigned, Daniel T Yon and Ralph J. Hagy, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Trust Deed Book 403 at page 485 having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on April 2, 2020 at 11:00 a.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real estate more particularly described as follows: All that certain lot or parcel of property near Skyview Drive and near Huntington in Guyandotte District of Cabell County, West Virginia, hereafter designated as LOT 13, SKYVIEW ESTATES, being more particularly described as follows: Beginning at a rebar and cap (set) at the south right of way line of Savanah Drive (Skyview Estates) and at the northwest corner of Lot #12 (Skyview Estates); thence leaving Savanah Drive (Skyview Estates) and running down the hill with the west line of Lot #12 (Skyview Estates), South 15-34-46 West 171.09 feet to a rebar and cap (set) at the northeast corner of Lot #14 (Skyview Estates); Thence leaving Lot #13 (Skyview Estates) and running up the hill with the north line of Lot #12 (Skyview Estates), North 74-30-34 West 175.56 feet to a rebar and cap (set) at the east right of way line of Dylon Road (Skyview Road); thence leaving lot #14 (Skyview Estates) and running with said right of way line, North 17-35-01 East 97.57 feet to a rebar and cap (set) at a point of curve; thence running along the arc of a curve to the right having a radius of 30.00 feet and a chord which bears, North 51-24-45 East 33.40 feet to a rebar and cap (set) at the south right of way line of Savanah Drive (Skyview Estates); thence leaving Dylon Road (Skyview Estates) and running with said right of way line of Savanah Drive (Skyview Estates), North 85-14-29 East 79.78 feet; South 88-10-17 East 80.09 feet to the point of Beginning, containing 25,377 square feet or Five Hundred Eighty Three Thousandths (0.583) Acre, as shown on the plat recorded in Deed Book 1064, at page 333. TOGETHER WITH a right of way at all times and for all purposes connected with the use and enjoyment of the land hereby conveyed and the grantees’ premises, in common with all other purposes having the like right and at all times hereafter, to pass and re-pass over and along Savanah Drive, as designated on said aforesaid plat and as extended, and over and along all other roads, drives, streets, of said Skyview Estates, SUBJECT to the payment of a fair proportion of the expense of maintaining and keeping said Savanah Drive, and contiguous road, if any, to said lot, in repair, until such time as a municipality, county or state shall assume such function; SUBJECT, FURTHER, HOWEVER, to the Utility Easements as shown on said plat. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended. Any sale may be conducted or adjourned by the designated agents or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as substituted Trustee.
