ORDER OF PUBLICATION On the 5th day of July, 2017, Plaintiff, Carol Hodges as administratrix of the Estate of Larry D. Garrett, filed a Complaint which initiated the above-styled action. A copy of the Complaint may be obtained from the Putnam County Circuit Clerk located at Putnam County Judicial Building, 2nd Floor, 12093 Winfield Road in Winfield, West Virginia. On the 17th day of July, 2019, Plaintiff, Carol Hodges as administratrix of the Estate of Larry D. Garrett, filed an Amended Complaint to add additional potential heirs to the Estate of Larry D. Garrett. A copy of the Amended Complaint may be obtained from the Putnam County Circuit Clerk located at Putnam County Judicial Building, 2nd Floor, 12093 Winfield Road in Winfield, West Virginia. The object of this action is to seek declaratory judgment to identify the proper heirs of the Estate of Larry D. Garrett and to sell a parcel of real property owned by the decedent at the time of his death. Pursuant to the Affidavit filed by Plaintiffs’ counsel, there are or may be persons, other than those named in the Amended Complaint filed in the above-styled case, interested in the subject matter of this action, whose names are unknown to the Plaintiff and who are made Defendants by the general description of “Unknown Heirs of Larry D. Garrett.” Additionally, pursuant to said Affidavit, the Plaintiff has used due diligence to ascertain the whereabouts of other named Defendants, without effect. WHEREFORE, it is ORDERED that the above-named Defendants must serve an Answer or other defense to the aforesaid Amended Complaint upon Plaintiffs’ attorney Matthew L. Ward, whose address is 611 Third Avenue, Huntington, WV 25701, on or before August 27, 2019. The original Answer shall be filed with the Circuit Clerk of Putnam County Circuit Clerk located at the Putnam County Judicial Building, 2nd Floor, 12093 Winfield Road, Winfield, West Virginia. Otherwise, judgment by default will be rendered against said Defendants at any time thereafter. Additionally any such Defendants should know that a Land Commissioner Hearing has been set for August 30, 2019 at 9:00 a.m. before Judge Phillip Stowers, 2nd Floor 12093, Winfield Road, Winfield, West Virginia, which said Defendants may appear to protect their interests.
