NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 7th day of May, 2014, Gregg L. Lowe, aka Gregory L. Lowe, aka Gregg Lowe, Grantor, to P. Andrew Vallandingham and Samuel Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2529 beginning at page 254, and the undersigned, Daniel T Yon and Ralph J. Hagy, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Trust Deed Book 403 at page 483 having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on April 9, 2020 at 11:00 a.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real estate more particularly described as follows: All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Gideon District, Cabell County, West Virginia, known and designated on a Revised Map of the said City of Huntington made by L.W. Leete, Civil Engineer, a copy of which map was filed in the Cabell County Clerk’s Office on December 31, 1903, as a part of Lot Number Twenty (20), OUTLOT NUMBER THREE HUNDRED FIFTY ONE (351), and being more particularly described as follows: Beginning at the point of intersection of the South line of Baer Street with the East line of Wilson Street; thence with said line of Wilson Street, S. 47-20′ W, 119.00 feet; thence S. 42-15′ E., 55 feet, more or less, thence N. 47-20′ E., 30.00 feet; thence N. 46-49 E. 99.28 feet to a point in the said line of Baer Street; thence with said street line N. 53-00′ W., 55.00 feet to the place of BEGINNING, as shown on the plat attached to deed recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 814, at Page 514. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended. Any sale may be conducted or adjourned by the designated agents or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as substituted Trustee.
