TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 22, 2012, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3874, at Page 158, Kerry A Stitzinger and Clark P Parker did convey unto Dru A Shope, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated February 21, 2020 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on April 7, 2020 at 4:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Chas SA District, Kanawha County, West Virginia, and more particularly described as follows: All those certain lots or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Charleston South Annex District, Kanawha County, West Virginia, and being more particularly described as follows: PARCEL ONE: All of Lot No. 28-A as said lot is shown upon a map entitled “Map Showing Resubdivision of Lots Nos. 28, 29 & 30 of Shadow Hills-Section Four Located in Loudon District, Kanawha County, W. Va.”, dated September 13, 1982, made by Field Engineering Co., and of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 36, at page 51, together with as an appurtenance to said Lot No. 28-A, all of a stone retaining wall which is now on said Lot No. 27 of Section Four of Shadow Hills Subdivision, together with an easement to perpetually maintain, repair and replace in its present location that portion of said stone retaining wall which is on Lot No. 27, as set forth in deed of record in said Clerk’s office in Deed Book 2097, at page 554. PARCEL TWO: Part of Lot Number Twenty-Seven (27) of Shadow Hills Subdivision, Section Four, Charleston South Annex District, Kanawha County, West Virginia, said lot or parcel being more particularly described as follows: BEGINNING at an iron pipe located along the northerly right of way line of Carriage Road, said pipe being located in the southerly common comer of the parcel herein conveyed and Lot 28-A of Shadow Hills Subdivision, Section Four; thence with a chord S. 66 55′ W. 40.40 feet to an iron pipe situate in the northerly right of way line of said Carriage Road; thence N. 30 25′ W. 134.94 feet to an iron pipe set; thence N. 68 00′ E. 30 feet to an iron pipe found; thence S. 34 47′ 30- E. 136.10 ft. to the place of beginning, and as shown on that certain map entitled, “Map Showing Part of Lot No. 27 of ‘Shadow Hills Subdivision’, Section Four, Loudon District, Kanawha County, West Virginia, To Be Conveyed From Charles E. and Keith O. Bryant to Thomas A. and Julie S. Dickie, Scale 1″ = 40′, dated March 24, 1986,” by D. K. Carr, R.P.C.E., which map is of record in said Clerk’s office in Deed Book 2128, at page 692. LSOT: Deed Book 2610, Page 383, dated August 12, 2004, Office of the Clerk of the County Commission of Kanawha County, West Virginia. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 22 Carriage Rd, Charleston, WV 25314. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
