SMITH, AND RANDY WILSON Defendants. ORDER OF PUBLICATION On January 11, 2019, Plaintiff filed an Affidavit requesting permission to perfect service of process upon Defendant, Gene H. Smith in the above-styled matter through publication, in accordance with West Virginia Rule of Civil Procedure 4. Consequently, Gene H. Smith you are hereby notified that a Complaint has been filed in the office of the Clerk of the above-named Court in an action seeking Thirteen Thousand Five Hundred Five Dollars and Thirty-Four Cents (“$13,505.34”) plus interest, costs, and attorney fees. A copy of the Complaint may be obtained at the Kanawha County Circuit Clerk’s Office, Kanawha County Judicial Building, 111 Court Street, Charleston, West Virginia 25301. You are further notified that if you have any objections or defenses to the judgment sought you are required to serve upon the Plaintiff’s attorney, Stacy A. Jacques, West Virginia Department of Transportation, Division of Highways, Legal Division, 1900 Kanawha Boulevard East, Building 5, Room 517-A, Charleston, West Virginia 25305, within 30 days of the first date of publication of this Notice, an Answer, stating all your objections and defenses to the judgment sought. A failure to serve an Answer shall constitute a consent to the request for judgment, to the entry of judgment against you, and shall constitute a waiver of all defenses and objections not so presented. You are further notified that if you have no objection or defense to the judgment sought, you may serve upon Plaintiff’s attorney a notice of appearance, and thereafter you shall receive notice of all proceedings. It is further ORDERED that this Order be published in the Charleston Gazette-Mail, a newspaper of general circulation published in Kanawha County, West Virginia, where this civil action is pending, once a week for two successive weeks.
